Meeting of Kingsbury Parish Council held on
Wednesday, 16th June 2010, at Piccadilly Community
Centre, Piccadilly.

left on an answer phone message but were too late to be included in the
minutes for this meeting and therefore the Council could not vote on
them).

Prejudicial Interests

651 Public Questions

652 Minutes to be Approved
It was proposed by Cllr A Lewis and seconded by
Cllr M Moss and agreed by all:
RESOLVED: That the minutes of the Council
meetings held on 19th May 2010 are approved as a true
record. These include the Annual meeting, the May Parish meeting and
the Annual Parish meeting.
653 Kingsbury Swimming Pool (627)
The June Steering Group meeting had to be postponed
as a few of the members could not make it. It is rescheduled for 5th
July. The parish website
www.kingsburyparishcouncil.co.uk will be updated when any
positive/new information is available.
654 Steps and footway into the Water
Park (628)
The excavation of a trial pit has now been done and
the problem seems to be water erosion rather than subsidence. The
tarmac path had been laid on an inadequate sub base which has allowed
water to flow under the tarmac. The result of this has been the tilt on
the steps and the crack in the tarmac.
The solution is to level the top flight of steps
onto a new sub base and relay the section of tarmac path (approx 30
metres)
The path is still legally closed but due to the
extensive use of the path, the surface has been reinstated so that it
can be used while a quote for the work is obtained.
655 Proposed New Play
Equipment-Recreation Ground, K’bury (629)
We are now waiting for the decision to find out if
we have been successful in our bid for funding for new play equipment at
the Kingsbury site. Our bid will go before the Directors of WREN on 24th
June 2010. We should hear the outcome by the end of June.
656 Piccadilly Play Area – gap by the
‘kissing gate’ (630)
NWBC may be able to obtain some fencing to repair
this gap for us but there was no further information available for this
meeting.
657 Community Speed Watch (631)
The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. This is an ongoing process to collect the necessary
amount of data for Sycamore Road, Kingsbury. It was decided that this
would be taken off the minutes while the collation of data was ongoing
and be raised again when there is any further information available.
658 Land Registry – Voluntary
Registration of the council’s land (632)
All the necessary forms are completed and the
actual site size is now confirmed to enable the Land Registry
application pack for Kingsbury Recreation ground, Church Lane to be sent
off. This should take up to five weeks to be processed.
659 Concerns regarding flooding and West
Midlands Water Ski Centre (634)
Concerns regarding the threat of flooding to
properties in parts of Fazeley, Bodymoor Heath and within Kingsbury
Water Park from the large earth bunds that surround the West Midlands
Water Ski Centre are being looked into by the Environment Agency. The
Environment Agency has recently confirmed that the Planning Team Leader
and the Legal Department are still pursuing this but they are unable to
give us any more information at present due to legal reasons. Also
following discussions with the Ski Centre the Environment Agency are
hopeful that the problem will be addressed.
660 Traffic problems EMR (635)
Queues of vehicles waiting to enter EMR causing
traffic problems on Trinity Road – The police have spoken to EMR
regarding the traffic issues but Councillors have enforced their
concerns to the police again about the problems as they fear there will
be an accident. The extent of disruption to traffic by lorries waiting
to get onto the site is getting worse.
The Clerk has written to EMR Head Office and let
them know of the ongoing problems with the site and is awaiting a
response. The police will also be writing to put their points across on
the matter.
661 Quality Parish Status (636)
The Clerk has asked Councillors to let her know
what items they would like to see in the first newsletter so that an
outline can be produced for the next meeting. Clarification will be
obtained on whether the newsletter can contain advertisements.
The other criteria will be worked through as an
ongoing process.
662 Marking of road and speed humps in
Wood End and Hurley (637)
WCC have reported that they have had a few problems
with the lining sub-contractor which had delayed the completion of
work. As far as WCC is aware all outstanding work has been completed.
Councillors were still concerned that some of the white and yellow lines
for Hurley and Wood End were still not completed. This will be followed
up.
663 Wooden Bus Shelter, Kingsbury (638)
An e-mail from a resident wishing to help preserve
the wooden bus shelter in Kingsbury has been received. Councillors were
keen to follow this up and look into what could be done for a small cost
to repair any damage. Councillors were waiting for a response from the
resident but in the mean time Councillors discussed what would need
repairing and a small amount of money for materials would be required.
It was proposed by Councillor A Lewis and seconded by Councillor K Giles
and agreed:
RESOLVED:That an amount of up to £100.00 could
be used to repair/preserve the wooden bus shelter on Tamworth Road,
Kingsbury.
664 Proposed Wood End Village welcome
signs window box planters (639)
A letter has now been sent to the Wood End
Neighbourhood Watch Association who will pass the information onto the
Wood End Community Association and the Garden Group informing them that
they can go ahead with the project and asking them to let us know or
send a photograph in when the planters are complete so that it can be
put on our website.
665 Litter problems around the parish

An e-mail has been received from a resident
concerned about the amount of litter left lying around the local area.
NWBC are responsible for litter picks and the Clerk has written to the
resident explaining the situation and frequency of litter picks from a
response received from NWBC and also what has been tried in the past and
what can be done if an area is particularly bad in the future. The
police are also aware of the problems.
666 Councillors Parish Matters Raised
April (641)
The following responses were received from the
relevant authorities:
- Is there any news on the lights that are
needed for Piccadilly? – The light is now in place and wired
up. The Clerk will ask WCC when it will be working.
- Could any HGV weight limit signs be put in
Whateley? – This is on an outstanding list of jobs to be looked
into by WCC. They will arrange to meet on site with Cllr B Moss and
possibly residents to discuss the matter further.
- The Perspex is out of place on the sign at
the Mill Crescent bus stop – This was supposed to be checked and
repaired as necessary at the end of May but is still damaged. The
Clerk to follow up.
667 Skip Hire for Clean up in Hurley

A
‘clean up’ around Hurley is planned for late June as a joint venture
involving the Coleshill Safer Neighbourhood Team, pay-back offenders and
NWBC Street Wardens. Two skips will be needed for this and the Parish
Council have been asked and agreed to pay for one of them.

There were no planning applications received this
month that required any comments or responses from the Parish Council.
669 Councillors Parish Matters raised

The following responses were received from the
relevant authorities:-

Is there any chance of a dog bin for Wood End and
Piccadilly? – NWBC will try and provide one for Piccadilly as there
is not one at present but as Wood End has one this may have to wait as
it is not classed as a priority.
·
No 8 Light out by 73/74 Piccadilly – This is still
out and will be followed up as it has been reported to WCC.
·
Path opposite EMR needs the bushes cutting back and
also the path from Kingsbury to Piccadilly – A defect has been
raised for the vegetation to be cut back off the footway by hand due to
the bird nesting season.
·
Path needs attention at Bodymoor Heath, left hand side
up to Water Park – This will be assessed for inclusion in the slurry
seal programme 2011.
·
River is at a very low level is there any work going
on? – No works taking place. The levels reflect the dry weather
base flow in the river which has occurred earlier than usual this year.
·
Rented property, St Margarets, K’bury, the wall is
crumbling away – County Highways will write to the owners of the
property.
·
School staff leaving cigarette ends opposite school
entrance – This has been reported verbally to the Headteacher but
Councillors asked the Clerk to write an official letter to the school.
·
Slat missing on bench opposite K’bury School – No
cost has yet been received from NWBC to replace the slat, but it was
reported that there are now two slats missing. A cost for the repair
will be followed up.

671 Volunteer Centre North Warks –
Request for Funding Support
A letter has been received from the Volunteer
Centre North Warwickshire asking for a donation towards their costs. A
copy of their annual report was also enclosed. Following discussions it
was proposed by Councillor I Thomas and seconded by Councillor A Lewis
and agreed:
RESOLVED: That a donation of £250 be given to
the Volunteer Centre to help with their work in North Warwickshire.
672 Kingsbury Church - request for help
with graveyard expenses
The applications for help towards the maintenance
of the graveyard at Kingsbury Church has been received together with the
financial records. These were discussed and it was proposed by
Councillor J Thomas and seconded by Councillor B Moss and agreed by
majority:-
RESOLVED: That Kingsbury Church be given the sum
of £950.00 for help towards graveyard maintenance.
Unfortunately the Hurley Church request was not
received in time to be put on the agenda and will be considered at the
next meeting.
673 Accounts for 2009/2010
The un-audited
accounts for 2009/2010 were circulated to all at the previous meeting so
that any questions/queries could be brought to this meeting and
discussed before the accounts were signed. No changes had been made now
that the Internal Auditor had completed his audit. The audit report was
circulated to all.
It was proposed by Councillor A Lewis and seconded
by Councillor J Thomas and agreed by all:
RESOLVED:-That the accounts for 2009/2010 be
approved subject to external audit, and also the Statement of Assurance
in the Annual Return.
Following the acceptance of the accounts, the Chair
signed the Statement of Assurance and the Annual Return. These
documents would be sent to the external auditor by the deadline of the
end of June.
Councillor I Thomas raised the question whether a
letter should be sent to the Internal Auditor prior to the audit so that
he could confirm his acceptance of the conditions and charge for the
audit. This has been done when the Auditor first audited the accounts
but an annual letter will be put in place in future starting with next
year’s audit.
674 Clerk’s Annual Pay Review
RESOLVED: That, under Section 100A of the Local
Government Act 1972, in view of the confidential nature of the business
about to be transacted, it is advisable that if any public are present
that they be temporarily excluded. This will be recorded as a separate
confidential minute.
675 Anti Social behaviour - Kingsbury
car park
A letter detailing concerns about Anti-Social
behaviour and some possible ideas for the car parks use has been
reported to the Parish Council and the Police. This was discussed with
the local PCSO and Councillors. Measures are being taken to solve the
problem by the police. However, it was felt that the car park was well
used and other ideas given were not practical.
676 Request to use extracts from parish
minutes
A request has been received from Mining Heritage
2006 Piccadilly to use some extracts from old parish minutes for a book
they are compiling on Kingsbury and Dexter Collieries and the villages
of Kingsbury and Piccadilly. They would need a letter to take to the
Archive office to say that the Parish Council have no objections. As
minutes are made public Councillors have no objections to this as long
as they acknowledge where the extracts are from. It was proposed by
Councillor M Moss and seconded by Councillor A Lewis and agreed:
RESOLVED: That a letter be written by the Clerk
to the Archive Office in Warwick giving Mining Heritage 2006 permission
to use the relevant minutes and an example of the acknowledgment to be
used would be given to them.

(via e-mail) This had been discussed with NWBC and as long as they
thought it was safe to leave the swings in place we would leave it
as we are waiting for the decision on the play area and it is not
worth spending any money on repairs at this point in time. If a
safety issue was raised it would be discussed further.
- Do DSV/TNT provide any facilities for their
drivers as lorries parking up overnight along Kingsbury Link are

628 Steps and footway into the Water
Park (604)
We have been informed by WCC that when the
contractor visited the site to do the scheduled work he discovered that
the top flight of steps appeared to have moved sideways since his last
inspection. A site meeting was arranged and any work suspended until
the subsidence problem could be looked into. However, in the interim
the contractor has installed a section of metal railings where the brook
flows under the path adjacent to the flood walk.
In order to determine the cause it will be
necessary to excavate a trial pit which will result in the steps being
closed. Signs will be displayed to warn the public of the closure.
More information will follow when we know the results of the excavation,
but it is hoped that the necessary work to stabilise the steps can be
done while the closure is in place.
629 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (605)
We are now waiting for the decision to find out if
we have been successful in our bid for funding for new play equipment at
the Kingsbury site. The advisory panel of WREN will consider our
application on 19th May and it will go before the Directors
of the company on 24th June 2010. We should hear the outcome
by the end of June.

A new sign has now been fitted.
634 Concerns regarding flooding and West
Midlands Water Ski Centre (612)
Concerns regarding the threat of flooding to
properties in parts of Fazeley, Bodymoor Heath and within Kingsbury
Water Park from the large earth bunds that surround the West Midlands
Water Ski Centre are being looked into by the Environment Agency. The
Environment Agency has assured us that a legal process is being followed
and it will be about two months before we hear any further progress
updates. This will be followed up for the July meeting.
NWBC have met with the new site owners and spoke at
length about the site and they have agreed to meet with the Planning
Department to go through the planning consents of the site and the
limitations of these consents. We will be updated on the outcome of
this meeting.
635 Traffic problems EMR (613)
Queues of vehicles waiting to enter EMR causing
traffic problems on Trinity Road – The police have spoken to EMR
regarding the traffic issues and also raised their concerns about the
debris on the road. EMR are now using a sweeper at regular intervals.
No response was received from an e-mail sent by the
Clerk asking EMR to follow up vehicles using the wrong route again and
the queues of traffic causing problems.
Councillors are concerned about the amount of times
that this has happened and nothing seems to be done to improve the
situation despite numerous complaints to EMR. Pedestrians some with
pushchairs are having to walk in the middle of the road between the
queues of traffic to get past and this is not acceptable. The Clerk has
been asked to write to EMRs Head Office and let them know of the ongoing
problems with the site.
636 Quality Parish Status (614)
The scheme was launched with the aim of providing a
benchmark minimum standard for Parish and Town Councils across the
country. It demonstrates a council’s ability to deliver efficient
services to local residents and speak with greater authority to
principal councils when seeking delegated functions which can be carried
out locally.
The Clerk has briefly looked into the cost to print
and deliver the newsletter that is required to send out to all residents
at least once a year. The other criteria will be worked through on an
ongoing process.
637 Marking of road and speed humps in
Wood End and Hurley (615)
The renewal has commenced but WCC have been advised
the work is not complete. They will ask the contractor to complete the
outstanding works.
638 Wooden Bus Shelter, Kingsbury (617)
An e-mail from a resident wishing to help preserve
the wooden bus shelter in Kingsbury has been received. Councillors were
keen to follow this up and look into what could be done for a small cost
to repair any damage. Councillors B and M Moss will contact the
resident and report back to the next meeting when it will be discussed
further.
639 Proposed Wood End Village welcome
signs window box style planters (618)
A request to attach window box planters to the
welcome signs in Wood End village has been received from Wood End
Community Association and Garden Group. They have the necessary funds
to complete this project but need to know that they are insured and any
permission has been granted. The Clerk has got written confirmation
from WCC that it is acceptable to attach the planters to the signs and
that the Parish Council Public Liability Insurance will cover them in
case of an accident. A letter will be sent to the Wood End Community
Association informing them that they can go ahead with the project.

Residents have offered to paint the telephone box
now that the parish council has adopted it. The Clerk has now supplied
them with the paint and brushes and a picture will be put on the website
when the job is done.

644 Skip Hire for Hurley
A
‘clean up’ around Queensway for the new allotments will be undertaken as
a joint venture involving the police, NWBC and local residents/groups.
Two skips will be needed for this and one is being paid for from NWBC
Allotment funding but they are asking if the Parish Council would be
able to fund the other skip at a reduced rate of £65.00. This was
discussed and proposed by Councillor H Phillips, seconded by Councillor
A Lewis and agreed by all:
RESOLVED: That Kingsbury Parish agree to pay for the second skip for the
clean up of Hurley at a cost of £65.00.

Accounts
The accounts for
2009/2010 were circulated to all at the meeting. They are currently
with the Internal Auditor and are therefore draft accounts. Councillors
will have to approve the accounts and the Chair will sign the statement
of assurance and the Annual Return on behalf of the Parish Council at
the June Parish meeting after they come back from the Internal Auditor.
They will then be sent to the External Auditor by the deadline date in
June.
Councillors are
therefore asked to examine the accounts and raise any queries/questions
at the June meeting before they are signed off.

603 Kingsbury Swimming Pool (581)
The Steering Group are meeting regularly to discuss
ways to keep the pool open for the long term. Ways of maximising the
pool use to gain the most income are being looked into and information
on attendance, hourly costs etc are being analysed. Councillors who are
on the Steering Group reported that they felt more optimistic after the
latest meeting.

positive/new information is available.
604 Steps and footway into the Water
Park (582)
There has been no work carried out by the date the
contractor had promised. The Clerk will find out more for the next
meeting.
605 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (583)
We are now waiting for the decision to find out if
we have been successful in our bid for funding for new play equipment at
the Kingsbury site. The advisory panel of WREN will consider our
application on 19th May and it will go before the Directors
of the company on 24th June 2010.
606 Piccadilly Play Area – gap by the
‘kissing gate’ (584)
Councillors feel this should be repaired by the
contractor as soon as possible, although NWBC say they will get it
repaired when they get the fencing installed at the Sycamore Road play
area. The Clerk will follow this up.
607 Community Speed Watch (585)
The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. This is an ongoing process of collecting data on
Sycamore Road, Kingsbury.
608 Playground inspection reports (587)
NWBC has now repaired the swing unit on the Church
Road recreation ground.
609 Community Project (588)
A date for the painting of the bus shelter in Wood
End is yet to be decided.
610 Land Registry – voluntary
registration of the council’s land (589)
The Land Registry application pack for Kingsbury
Recreation ground, Church Lane will be sent with the payment of £40.00
as previously agreed.
611 Signpost by school is in need of
repair/re-aligning (590)
A new sign has now been requested but we don’t know
how long this will take to arrive and be fitted. Further information
will be requested.
612 Concerns regarding flooding and West
Midlands Water Ski Centre (591)
Concerns regarding the threat of flooding to
properties in parts of Fazeley, Bodymoor Heath and within Kingsbury
Water Park from the large earth bunds that surround the West Midlands
Water Ski Centre are being looked into by the Environment Agency. The
Environment Agency has assured us that a legal process is being followed
and it will be about two months before we hear any further progress
updates.
Councillors asked the Clerk to check with NWBC
whether the camping and caravanning at the Ski Centre has any necessary
planning permission or complies with regulations and also the position
with regard to the restaurant facilities. This is being looked into by
NWBC and a response is awaited.
613 Councillors Parish Matters Raised
February (593)
The following replies/reports have been received
from the relevant authorities:
- Verge in front of Wood End School-can
tarmac be put down? – There are insufficient funds to tarmac
this verge and County Highways are suggesting contacting the County
Cllr for consideration from his budget.
- Queues of vehicles waiting to enter EMR
causing traffic problems on Trinity Road – The police have been
asked to monitor this as it is an ongoing problem. Also Cllrs
reported that staff at EMR were on the road directing traffic
because of the disruption they were causing. Other issues raised
regarding the traffic chaos will be followed up.
614 Quality Parish Status (596)
The Secretary of WALC was unable to attend the
meeting to answer questions and explain the scheme more fully, but had
sent some information to the Clerk. Councillors were given the
information and the criteria for the scheme. It was discussed at length
and decided that the parish council would start working towards the
status. Some of the criteria were already being met and others such as
regular newsletters would be looked into.
The scheme was launched in 2003 with the aim of
providing a benchmark minimum standard for Parish and Town Councils
across the country and revised in 2006. It demonstrates a council’s
ability to deliver efficient services to local residents and speak with
greater authority to principal councils when seeking delegated functions
which can be carried out locally.
615 Councillors Parish Matters Raised
March (597)
The following responses/reports have been
received/sent:
- Pupils waiting for bus after school on
Tamworth Road are causing a nuisance – This problem has been
reported to the school and the police because it becomes difficult
for the school to do much as it is after school finishes. However,
the culprits should be catching the bus from the school site and the
bus companies have been told not to pick them up from the main
road. The police will monitor the situation.
- Kerbstone needs attention, entrance to Oak
Tree Close – This has been inspected and a defect for repair
raised.
- Dog fouling-alley way leading to school and
library, Kingsbury – This has been reported and acknowledged by
NWBC and has now been cleared up.
- Marking of road and speed humps in Wood End
and Hurley getting urgent – The renewal has now commenced but
not finished. A date for the rest of the markings will be obtained.

617 Wooden Bus Shelter, Kingsbury
An e-mail from a resident wishing to help preserve
the wooden bus shelter in Kingsbury has been received. Councillors were
keen to follow this up and look into what could be done to repair any
damage. Cllrs B and M Moss will meet with the resident and report back
to the next meeting.
618 Proposed Wood End Village welcome
signs window box style planters
A letter asking for permission to attach window box
planters to the welcome signs in Wood End village has been received from
Wood End Community Association and Garden Group. They have the
necessary funds to complete this project but need to know that they are
insured and any permission has been granted. The Clerk will look into
whose insurance covers this and report back to the next meeting.
619 Litter problems around the parish
An e-mail has been received from a resident
concerned about the amount of litter left lying around the local area.
NWBC are responsible for litter picks and the Clerk will find out how
often these are carried out. Councillors share the concerns and a reply
will be sent to the resident explaining the situation and what has been
tried in the past.

621 Whateley Telephone Kiosk
Residents have offered to paint the telephone box
now that the parish council has adopted it. The Clerk has supplied them
with the necessary guidelines and investigated the correct paint to
use. It was proposed by Councillor B Moss and seconded by Councillor A
Lewis and agreed by all:
RESOLVED: The parish council would purchase the
paint and a couple of brushes for painting the telephone kiosk at
Whateley at a cost of £38.44.

The Steering Group met for a second meeting in
March. Items raised from the initial meeting were reported on and will
be further looked into. The timetable and users will be analysed to see
if better use of the pool can be made. Options for extending were
looked into but they obviously come with a cost.
It was proposed by Cllr H Phillips and seconded by
Cllr A Lewis and agreed that the members of the parish council who are
on the Steering group be delegated the powers to discuss the ‘parish
sessions’ at the pool. Any decision would then have to be ratified at a
full Parish meeting. The parish website

With the help of North Warwickshire Borough Council
the Clerk has completed the lengthy application form to apply for help
with funding for new play equipment at the Kingsbury site. This was due
to be completed by 17th March and the date when a decision
can be expected is 1st July 2010. The contractor amended the
plans slightly for us to create some ‘natural’ play items into the
design to comply with the latest ‘green’ criteria that is expected.
It was agreed that a letter of thanks be sent to
NWBC for their help.

NWBC at the same time as they start to install the fencing at the
Sycamore Road play area. No date for this is available yet.

One of the swings has been removed on the Church
Road recreation ground because of a faulty bearing and some of the nuts
need tightening. NWBC has raised a request to get these items done for
us but we do not have a date yet.

The following updates were received from the

- Can the footpath around the recreation
ground gate be filled? – NWBC will get this filled for us.
- Untidy piece of land between the gate into
the field and the bridge opposite the entrance to Mill Crescent
– It has been confirmed that County Highways are responsible for
this. Work has been carried out to remove some trees and pruning
around the electricity cables.
- Signpost by school is in need of

592 Temporary closure of Trinity Bridge, Trinity Road 22nd
– 28th March 2010 (572)
WCC Road Traffic Regulation Act 1984, Section
14-Temporary closure of bridge for carriageway repairs. Councillor I
Thomas asked the Clerk to find out what measures were being put into
place while the bridge was closed as local residents needed to know to
make alternative arrangements. After many telephone calls and e-mails
the information and timetables for a shuttle bus were finally received a
few days before the closure. All information was put on the parish
website.

595 Clerk’s qualification
Councillors congratulated the Clerk for passing the
‘Certificate in Local Council Administration’ qualification which she
had been studying for. It is recognised by SLCC and WALC and it is
advised that an increment should be given in recognition of this. It
was proposed by Councillor B Moss and seconded by Councillor H Phillips
and agreed by all that:
RESOLVED: The Clerk would receive one increment
on the Clerk’s pay scale for obtaining the qualification, taking her to
LC2 SCP 28. This would be implemented on the next salary cheque (April
2010).
596 Quality Parish Status
WALC have suggested that the Parish Council applies
to become a ‘Quality Parish Council’ now that the Clerk is qualified as
this is a requirement for the award. Some basic requirements were
discussed, some of which are already being actioned, but it was agreed
to invite the Secretary of WALC to the next meeting to answer questions
and explain the scheme more fully. Councillors will be supplied with
more details in time for the next meeting.

556 Kingsbury Swimming Pool (530)
The Steering Group met for an initial meeting early
in February. This was to look at funding options and running costs etc
to enable the pool to remain open for the long term. There was not a
lot to report back from this initial meeting but it is hoped that
‘action items’ from the meeting will provide more information at the
next meeting on 15th March 2010. The parish website
www.kingsburyparishcouncil.co.uk will be updated when any
positive/new information is available.
557 Steps and footway into the Water
Park (531)
WCC raised the order for the work and told the
contractor to carry the work out as soon as possible many months ago.
The contractor has apologised for the delays which are due to Staff
health issues and workload. He has promised that the work will be
completed before the end of March.
558 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (533)
We have now secured an amount of third party
funding from NWBC in the sum of £5,500 and this will now enable us to
apply for further funding. The Clerk met with a representative from
NWBC to discuss the way forward with funding. The plans for the play
area need amending to conform with new guidelines ie take out the
fencing around the site. It was agreed that we had waited a long time
for the funding criteria to become available and we should push on and
try and meet the deadline of 17th March for the funding
application. The contractor will be asked to amend the plans in time to
complete the funding bid.
559 Piccadilly Play Area (534)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. This
will be addressed by NWBC at the same time as they start to install the
fencing at the Sycamore Road play area.
560 Community Speed Watch (535)
The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. This is an ongoing process of collecting data on
Sycamore Road, Kingsbury to see if we meet the criteria for the scheme
to get underway. Due to the bad weather this has not progressed any
further.

The bench has now been fitted for us by NWBC.
562 Councillors Parish Matters Raised
September (539)
The following responses have been received from the
relevant authorities:-
- Weeds are coming through the footpath at
the top of Wood Street – This has been reported again and a
response is awaited.
- Car Park barrier is closed and football
players are changing on the side of the road. Football clubs are
requesting changing facilities – NWBC are in the process of
preparing a brief for consultants to develop a Playing Pitch
Strategy for the Borough, which will include consideration of the
need for ancillary facilities. Local clubs and the Parish Council
will be consulted on these issues before anything is agreed.
Although this may take some time.
The car park was
initially fitted with a barrier to stop young people driving onto it and
causing a nuisance. NWBC are currently looking into a solution for this
problem.
563 Playground inspection reports (540)
One of the swings has been removed on the Church
Road recreation ground because of a faulty bearing and some of the nuts
need tightening. NWBC has raised a request to get these items done for
us as there is only a very small cost implication.

The following were reported to the relevant
authorities:-
- Speed aware signs on Tamworth Road/Coventry
Road not working – These are now in working order.
- Request for a pelican crossing for Wood End
– WCC have carried out a survey and unfortunately the criteria are
not met to implement a crossing at this time.
- Soil/rubbish has been tipped in the drain
opposite Wood End School – This has now been cleared along with
a large amount of litter.

A date for the painting of the bus shelter in Wood
End is yet to be decided.
566 Land Registry – voluntary
registration of the council’s land (543)
The Clerk has now received the application pack and
this will be completed and sent with a one off payment of £40.00 as
previously agreed.
567 Councillors Parish Matters Raised
December (544)
The following updates were received from the
relevant authorities:-
- Can the footpath around the recreation
ground gate be filled? – NWBC will fill this for us.
- Untidy piece of land between the gate into
the field and the bridge opposite the entrance to Mill Crescent
– It has been confirmed that County Highways are responsible for
this and the Clerk will check with them when they can tidy it up.
- Signpost by school is in need of
repair/re-aligning – This has been reported to NWBC and a reply
is awaited.
568 Concerns regarding flooding (545)
Concern from residents from Bodymoor Heath and the
Parish Council regarding the threat of flooding to properties in parts
of Fazeley, Bodymoor Heath and within Kingsbury Water Park from the
large earth bunds that surround the West Midlands Water Ski Centre have
resulted in a meeting with residents and Councillors B Moss and J
Thomas. The Environment Agency has written back assuring us that a
legal process is being followed and they are not able to comment at this
time but we will be informed if there is any progress to report.
Councillors also asked the Clerk to check with NWBC
whether the signs advertising members camping and caravanning at the Ski
Centre comply with regulations and any permission needed has been
gained.

The costs have been noted for future reference if
we want to put plaques on any parish benches to show the public who
provided them.

The following responses have been received from the
relevant authorities:
- Uneven pavement in Kingsbury between
Telephone box and Chip shop – This has been put forward to be
assessed for inclusion in the slurry seal programme 2011.
- Lamp 41, Tamworth Road, Wood End out –
This has been repaired
- Pavements by 19-21 Wood Street, Wood End
are cracked – These have been marked for patching.
- The Arriva bus timetable at the Mill
Crescent stop has been vandalised – WCC will inspect the
timetable case to either repair or replace and contact Arriva to
supply a new timetable.

572 Temporary closure of Trinity Bridge, Trinity Road 22nd
– 28th March 2010
WCC Road Traffic Regulation Act 1984, Section
14-Temporary closure of bridge. More information will be put on the
parish website. Councillor I Thomas asked the Clerk to check if the
kerb stones are being replaced at the same time as the carriageway
repairs.
573 Hurley Community Assoc-request for
alterations/refurbishments to Village Hall
Hurley Community Association are looking into
refurbishments for the Village Hall and asked the Clerk to find out if
they need permission from CISWO and the Parish Council before going
ahead with these, and also if there are any long term plans for the
hall. Both CISWO who own the building and the Parish Council who are
trustees need to be kept informed of any possible changes to be made.
There are unlikely to be any objections from either to proposed
improvements to the hall. The Clerk will let HCA have the e-mail
contact for CISWO to keep them informed.

RSPB are seeking match funding from a number of
local organisations to enable them to gain further funding for the new

RESOLVED: A donation would be given of £200.00
towards the RSPB nature reserve project.

530 Kingsbury Swimming Pool (509)
Following the meeting of the Cabinet on 17th
December, the recommendation to keep the pool open for another year was
agreed. This will allow time for a steering group to be set up to look
into funding options and running costs etc to enable the pool to remain
open for the long term. A Steering group will be formed to hopefully
meet early in the new year.
The parish website

information is available.
531 Steps and footway into the Water
Park (510)
WCC raised the order for the work and told the
contractor to carry the work out as soon as possible many months ago.
The contractor has apologised for the delays which are due to Staff
health issues and workload. He has promised that the work will be
completed before the end of March.
532 Secure Stop Gates for Hurley and
Kingsbury (511)
It has been agreed to install ‘Secure stop kissing
gates’ at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads and also in Range Way, Kingsbury leading to the Linear Park. The
gates have now been installed.
533 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (512)
NWBC have allocated £10,000 for each area forum
towards projects that help to deliver the priorities set out in the
Green Space Strategy. We have applied to this fund and put in a bid for
this money to help with securing further funding for the play area. A
decision is not due until early February.
534 Piccadilly Play Area (513)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. This
will be addressed by NWBC at the same time as they start to install the
fencing at the Sycamore Road play area.

NWBC have taken delivery of the bench for us. This
was due to be fitted just before Christmas but the weather has delayed
this.
537 Path by bridge into Water Park is
washing away (516)
The path was last repaired in April 2009 and WCC
feel that at present it is of a suitable standard for a public footpath
in a rural setting. If a higher standard of surface is required then it
would be the Country Parks section that would have to finance and
organise the work. It was agreed to monitor this and report again if it
gets worse.
538 Wooden Bus Shelter, Kingsbury (517)
As the structure is stable and not considered
dangerous or unsafe by NWBC, it was decided not to plan for a
replacement at this point in time. The state of the roof space was
noted but this was caused by vandalism and there are no plans to repair
this at the moment. This will be monitored for the future.

- Path T68, bushes are overhanging by stile
– This is to be checked to see if the work has been completed.
- Near Dexter Court there is a loose cast
iron lid – County Highways have given us the contact number for
residents to report this directly to STWL.
- Weeds are coming through the footpath at
the top of Wood Street – This is to be reported again.
- Stile and sign removed from Boulters Lane
ref AE67 and AE68 – A new signpost was installed at Boulters
Lane and waymarking was undertaken by WCCs Ranger Team.
- Car Park barrier is closed and football

wait for them to look into this.
- Street lights needed for Piccadilly –
This is still on the improvement list but funding is a problem. WCC
and County Cllr B Moss are aware of this request. It will have to
be looked into next financial year.
- Sign covered by undergrowth, Kingsbury Link
– This has now been cut back
- Soil/rubbish has been tipped in the drain
opposite Wood End School – This has also been reported but is
still there. To be followed up.

A letter has been received from the land registry
office regarding registering the Council’s land to enable proof of
ownership. This was previously discussed and agreed this would be a
good idea but the Clerk was asked to find out further information. The
Clerk reported on a conversation with Land Registry and an application
pack will be sent out to be completed and the cost would be a one off
payment of £40.00. It was proposed by Councillor H Phillips and
seconded by Councillor B Moss and agreed that:
RESOLVED: The Parish Council would register the
recreation ground at Church Lane, Kingsbury to establish proof of
ownership at a cost of £40.00.

- The grit bin at Pit Hill needs refilling
– This has been added to County Highways list and will be filled
- Sump holes on Trinity Road need cleaning
out – A defect has been issued for the jetter to jet all
drainage Trinity Road from Piccadilly Crescent to Bridge
- Traffic calming humps and lines need
repainting, Wood End- These will be included in the next
available road marking programme.
- Is the Arriva bus 767 to airport continuing
in January – Arriva have no plans at present to change this
service

Dosthill – A sweeper attended on 2/12/09 to clear the road.

547 Council Taxbase and Precept
Requirements for 2010/2011
Councillors considered a report provided by the
Clerk, based on current expenditure and estimated out-turn for
2009/2010. Councillors discussed this at length and it was proposed by
Councillor H Phillips and seconded by Councillor B Moss and agreed:-
RESOLVED: That an expenditure budget of £30,000
be approved for the year 2010/2011, and that the precept levy on North
Warwickshire Borough Council would be £30,000. (an increase of £1000)
548 Review of
Effectiveness of Audit
A meeting is required once a year to review the
accounts procedures for audit purposes. The Chair, Vice-Chair and Clerk
met in January to discuss this. The outcome was that the system of
accounting and the procedures in place by the Clerk and Internal Auditor
are more than satisfactory and there is no need for any changes to be
made.

The Clerk provided some figures on how much it
would cost to have a plaque engraved and put onto the benches that the
Parish Council has provided for the community. Costs depend on
materials used etc but range between £20 to £30 each.

507 Public Questions
A concerned resident from Bodymoor Heath has
written to ask for the Parish Councils help and support with regard to
the threat of flooding to properties in parts of Fazeley, Bodymoor Heath
and within Kingsbury Water Park from the large earth bunds that surround
the West Midlands Water Ski Centre.
This matter was discussed at length and it was
agreed to arrange a meeting with the resident, County Councillor B Moss
and Bodymoor Heath Parish Councillor J Thomas to decide on the action to
take.
508 Minutes to be Approved
It was proposed by Cllr B Moss and seconded by Cllr
I Thomas and agreed by all:
RESOLVED: That the minutes of the Council
meeting held on 21st October, 2009 are approved as a true
record.
509 Kingsbury Swimming Pool (487)
The future of the Swimming pool was discussed at
the Area Committee meeting on 25th November 2009. Prior to
the meeting a lot of work was done by the Parish Council to inform the
local community of the threat of closure. This included hand delivering
leaflets to parishioners explaining the situation and asking for support
by e-mailing the members of the Area Committee or completing forms that
were left all around the parish. MP Mike O’Brien and the Head at
Kingsbury School were also involved in getting the situation into the
public domain.
The response was excellent and thank you to
everyone who wrote, e-mailed or attended the meeting. The people that
spoke at the meeting and all the e-mails and written forms left the
committee members in no doubt that the pool was a well used resource
that should not be closed. The Area Committee members voted unanimously
to recommend to the Cabinet meeting on 17th December to keep
the pool open for another year to give time for a steering group to be
set up to look into funding options.

of the Wooden Bus Shelter, Tamworth Road. It has been previously looked
at by NWBC and is not considered to be unstable or unsafe, however,
there are repairs needed to the roof space. This will be discussed at
the January meeting when the next year’s budget and precept are decided
on.

is on all day because the trees need cutting back – Part of the
trees have been cut back but the hedges also need trimming.

time for the meeting.
- Near Dexter Court there is a loose cast
iron lid – This has been checked by highways and all stop taps
are on site, but it is maintained by NWBC Housing Dept and will be
reported to them as it is still a problem.
- Dead tree Wood Street, request for
replacement – WCC do not think they will be able to replant this
season but will arrange for a tree to be planted.

- Kingsbury School floodlights are on all
night – The caretaker will look into costs to link all the
school lights to one main control to assist him when the alarm goes
off, but the lights being on is a deterrent to burglars.
- Large van parking opposite Kingsbury Chip
shop blocking the pavement – The police are looking into this.
- Students throwing litter after school in
Kingsbury – This is difficult to monitor but the school are
aware of this.
- Speed aware signs on Tamworth Road/Coventry
Road not working – These have been reported to WCC who then
action the contractors to repair them.
- Could we enquire about a pelican crossing
for Wood End – WCC have been sent the location as requested and
we now have to wait for them to look into this.
- Light in Dexter Lane on continuously –

521 Community Project (503)
PCSO P Beale and Kingsbury School have organised a
project to involve the school children helping in the community by
painting the Wood End, bus shelter and planting some pots at either end
of Kingsbury village.
On the first of the community days some pots were
planted up and placed by Jubilee Court and on the school site as it has
not yet been cleared with County Highways to place them on the grass
verges. Also a litter pick in the village was carried out.
The painting of the bus shelter is to be done on
another day in the new year.

487 Kingsbury Swimming Pool (466)
The future of the Swimming pool is on the agenda of
the Area Committee meeting on 25th November 2009 at NWBC
offices at 6pm. The situation was discussed at great length and it was
decided to send the statement from the Parish Council to the Tamworth
Herald and get leaflets distributed to all areas for the public to
complete or to e-mail the Clerk with their support. The schools using
the pool would also be contacted and the Councillors on the Area
Committee. MP Mike O’Brien is also getting involved. It was felt that
we could not wait until a decision has been made as time was running
out. The information is also posted on the parish website
www.kingsburyparishcouncil.co.uk
488 Steps and footway into the Water
Park (467)
WCC have raised the order for the work and told the
contractor to carry the work out as soon as possible. Staff health
issues have delayed the work but any backlog should be completed as a
priority in the next few weeks. The Clerk will follow this up to find
out the date for the work.
489 Secure Stop Gates for Hurley and
Kingsbury (468)
It has been agreed to install ‘Secure stop kissing
gates’ at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads and also in Range Way, Kingsbury leading to the Linear Park. A
site visit took place and a slight variation in size would be needed to
the quote resulting in an extra cost of £261.80. It was proposed by
Cllr H Phillips and seconded by Cllr A Simpson and agreed that:
RESOLVED: That the revised quote of £2,390.10
be accepted and the gates ordered.
490 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (469)
NWBC have allocated £10,000 for each area forum
towards projects that help to deliver the priorities set out in the
Green Space Strategy. We will be putting in a bid for this money to
help with securing further funding for the play area. A decision is not
due until early February. Sources of funding for the project will be
looked into.
491 Piccadilly Play Area (470)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. There
is still no further information from NWBC.
492 Wood End bus stop

PCSO P Beale reported that the police would be
organising the painting of the bus shelter. See also minute 503.
493 Community Speed Watch (472)
The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. We are in the process of collecting data on Sycamore
Road, Kingsbury to see if we meet the criteria for the scheme to get
underway.

- Road needs attention on Tamworth Road by
the Islington development following the building work–
County Highways have advised us that the carriageway has been marked
for patching and work will start at the end of October.

NWBC are able to take delivery and fit the bench
for us. The base will need to be checked out before ordering so that
the correct fixings can be purchased. As soon as this is established
the bench will be ordered.

497 Path by bridge into Water Park is
washing away (476)
A response is awaited from WCC who are looking into
this.
498 Wooden Bus Shelter, Kingsbury (478)
Concerns have been reported regarding the condition
of the Wooden Bus Shelter, Tamworth Road. It has been previously looked
at by NWBC and is not considered to be unstable or unsafe, however,
there are repairs needed to the roof space but it was decided to discus
this more fully in November when we consider any items for the budget
for the coming financial year.
499 Councillors Parish Matters Raised
September (481)
The following responses have been received from the
relevant authorities:-
- Edge Hill, Lamp 28 has no cover and lamp 29
is on all day because the trees need cutting back – An order has
been raised to get the trees cut back.
- Path T68, bushes are overhanging by stile
– WCC are investigating the matter.
- Church sign, Wood End has been broken off
– This has now been replaced.
- Near Dexter Court there is a loose cast
iron lid – This has been checked by highways and all stop taps
are on site, but it is maintained by NWBC Housing Dept and will be
reported to them as it is still a problem.
- Dead tree Wood Street, request for
replacement – Request put to WCC.
- Weeds are coming through the footpath at
the top of Wood Street – This is to be looked into.
- Stile and sign removed from Boulters Lane
ref AE67 and AE68 – This will be looked into by WCC.
- Car Park barrier is closed and football
players are changing on the side of the road. Kingsbury football
club are requesting changing facilities – NWBC are looking into
changing facilities in Kingsbury over the next few months.
Councillors are concerned that emergency vehicles would not be able
to get through if needed. This will be passed onto NWBC.
- DSV lorries still using Whateley lanes
– The Clerk to write to DSV regarding this ongoing problem.

503 Community Project
PCSO P Beale and Kingsbury School have organised a
project to involve the school children helping in the community by
painting the Wood End, bus shelter and planting some pots at either end
of Kingsbury village. It was discussed and proposed by Cllr B Moss and
seconded by Cllr K Giles that the Parish Council would fund, up to £50
for paint (to be green) and brushes etc for the project. The Clerk
would also look into the insurance cover related to this.
RESOLVED: Up to £50 will be given to pay for
materials for the community project.

445 Public Questions
There were no public questions raised at the
meeting but the following updates were received relating to the issues
raised last month:-
- Hazardous parking near the junction of
Tamworth Road and Sycamore Road. The police will monitor this
and have already advised some motorists who were causing an
obstruction. WCC Traffic section did respond to the request for
double yellow lines in this area but unfortunately this was not
possible.
- Sycamore Road Play area – proposed safety
fencing. The local Neighbourhood Watch group have raised
between £2,000 - £3,000 towards this. NWBC are in the process of
obtaining quotes for the work and will report back when they have
more information.
- Future of Kingsbury Pool. A
representative from WCC came to the meeting to update Councillors on
the situation with regard to the future of the pool. Negotiations
are ongoing between two possible interested parties, to try to
secure alternative management for the pool. The decision whether
these have been successful or not is not due until the end of
October or early November.
Councillors discussed
this further and decided to arrange a meeting to discuss the options and
what the parish Council could do in the event of the decision being
closure as no-one wants to see the pool close.

future. WCC have raised the order for the work and told the contractor
to carry the work out as soon as possible.
448 ‘Black Path’ (425)
It has been suggested that chicanes are created at
the two points where they leave Meadow Road and Hawthorn Avenue, Hurley
so as to prevent access by motorcyclists and those using quads.
Councillor B Moss suggested that one was also put in Range Way leading
to the Linear Park. After discussion, it was decided to get a further
quote for the September meeting, to include three chicanes as the price
could be negotiated for a larger order. It would then be discussed to
decide who should fund this and if the work should be done.
449 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (426)
The plan, design and costs for the proposed play
area have now been received and Councillors were impressed with these.
Further liaison with the company will be needed in the future to
establish the exact positioning of the equipment. The Clerk will now
look into the process of applying for funding.
450 Piccadilly Play Area (427)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. NWBC
are hoping to meet with the contractors soon and will ask them to come
and look at this to see what can be done.
451 Adoption Scheme - Red Telephone
Kiosks (428)
The Adoption of the Kiosk is now complete. BT have
removed the telephone equipment and disconnection of the power supply
should take place on 20th July.
452 Wood End bus stop
(429)
PCSO G Scott suggested that the bus shelter could
be painted by community helpers if we supplied the paint to make it look
more pleasing on the eye. No update on this had been received in time
for the meeting.
453 Community Speed Watch (430)

454 Councillors Parish matters raised
February (431)
- Path edges need trimming on the Church Road
recreation ground – NWBC can quote for a one-off or annual trim
and add it to our schedule. NWBCs quote was considered excessive
and they would not be able to carry out the work until the Autumn.
Therefore, the Clerk has been asked to gain further quotes and it
was agreed by Councillors that the Clerk would liaise with the Chair
when the price was received and agree for the work to be done if
another more acceptable quote was received.
- Road needs attention on Tamworth Road by
the Islington development following the building work– Vehicles
have driven over the verge since Highways repaired this and it will
need to be reported again when the new locality officer takes over.
County Highways have recommended that we wait and see whether the
edging kerb improves the situation or not at the bus stop.
455 New Bench for Piccadilly (432)
The Clerk will ask NWBC if they can take delivery
and fit the bench for us. The base will need to be checked out before
ordering so that the correct fixings can be ordered.
456 Noise from EMR on
Sundays (435)
Councillors asked the Clerk to let EMR know that
drivers were again using the wrong route to and from the site and there
have been numerous lumps of metal on the road recently. EMR have
already instructed their drivers of the correct route and a map is
displayed at the weighbridge but they will refresh the instruction to
all drivers. They employ a sweeper for the site and along Trinity Road
and will remind all operators/drivers of the responsibility to make sure
their load is safe.
457 Volunteer Centre North Warks (438)
A letter of thanks has been received from the
Volunteer Centre North Warwickshire for the donation towards their
costs.

June (440)
The following will be raised with the relevant
authorities:
- Can NWBC provide some dog bins in
Piccadilly – NWBC have no capital budget but are aware of the
problem at this and other sites and will look into it.
- The hedges are overgrown and are causing
problems for people using the path by the bungalow opposite
Kingsbury School – County Highways wrote to the Agent and the
work has now been done.
- Children leaving Kingsbury School, Tamworth
Road are seen smoking well before they leave the school site –
This has been reported to the Headteacher who will look into it.
- The overgrown tree in a garden in Coventry
Road is covering the Bus stop sign – A letter has been sent to
ask that a resident cuts the tree back. It now looks as if it is
only partly the tree in the garden and a lilac tree in the Linear
park that is covering the sign. This will be further investigated.

422 Public Questions
The following questions/problems were raised:-
- Hazardous parking near the junction of
Tamworth Road and Sycamore Road. This was raised while the
local PCSO was still in attendance. He will report back so that
this can be monitored by the police. Also the Clerk will write to
WCC Traffic section to ask if double yellow lines can be put in this
area.
- Sycamore Road Play area – proposed safety
fencing. A resident updated Councillors in his quest to get
funding towards safety fencing along the road by the play area.
Neighbourhood Watch have raised between £2,000 - £3,000 towards
this, but the total cost could be as much as £10,000. Councillors
unanimously support this project, but pointed out that it is NWBC
land and NWBC would first need to be contacted to see how much money
they could put towards this project. If there was a small shortfall
then the Parish Council would consider if they could help.
It was also reported by
Councillor M Moss that NWBC has now given Sycamore Road play area
priority for improvement by 2010/2011, but the fencing is a separate
issue and not part of the play area.
- Future of Kingsbury Pool. A
representative for residents concerned about the possibility of the
pool having to close asked for support from the Parish Council. As
recently put in a press release all Councillors want to see the pool
stay open for the community, but as stated the parish Council is not
in a position to take over the running of the pool financially.
Some options for alternative management are still being looked into
and there has been no indication of when and if the pool is to close
from WCC who are responsible for the running of the pool.
Councillors discussed
this further and the Clerk will contact WCC for more information.
423 Minutes

424 Steps and footway into the Water
Park (398)
The work has still to be commenced. This involves
raising the height of the hand rail along the side of the steps,
erecting a section of metal fencing at the point the path crosses the
brook close to the bottom of the steps and to surface a small section of
T27. WCC have given the order to the contractor and told them to carry
the work out as soon as possible. The contractor has had health
problems but any backlog of work will be given priority.
425 ‘Black Path’ (400)
WCC have suggested to NWBC that chicanes are
created at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads. A cost has been requested for the chicanes by NWBC which is
still awaited, but the Parish Clerk has received an updated quote to
include fitting of £697 + VAT, with possible reductions for more than
one. It was decided to wait for NWBC to come back to us with a cost and
then to discuss who should fund this and if the work should be done.
426 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (401)
Unfortunately the plan, design and costs for the
proposed play area have still not been received. It is now hoped to
have the results in time for the next parish meeting. The Clerk has not
received any further pledges for part or all of the £5,500 that we need
to raise as third party funding. This is a requirement of the
application for funding. NWBC may have some money becoming available in
the near future that could count towards this. In the meantime some
further letters will be sent.

have said that when the contractors commence work on the Atherstone
project they will ask them to come and look at this to see what can be
done. We are still awaiting an answer.

The Adoption of the Kiosk is now complete. BT have
removed the telephone equipment and the Clerk has asked for the work on

The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. We are in the process of collecting data on Sycamore
Road, Kingsbury to see if we meet the criteria for the scheme to get
underway.

Also the issue of speeding cars along Sycamore Road
has been brought up again by residents. WCC Road Safety Unit has
responded to the Clerk’s letter and unfortunately resources are limited
and work of this nature has to be prioritised in the most cost effective
way. The standard practice amongst many local authorities, including
Warwickshire, is to prioritise engineering measures by targeting those
sites with the highest number of collisions with personal injury.
Sycamore Road has been assessed by the engineering team and the
collision history is relatively good compared to many other sites in
Warwickshire. Therefore, a greater reduction in road casualties can be
achieved by targeting engineering at other sites. WCC do work in
conjunction with the police on road safety issues and the police have
agreed to do some speed checks for us along Sycamore Road.

- Path edges need trimming on the Church Road
recreation ground – NWBC can quote for a one-off or annual trim
and add it to our schedule. NWBC have now stated that someone will
go out and assess the job and let us have a cost as a matter of
urgency. It was agreed by Councillors that the Clerk would liaise
with the Chair when the price was received and agree for the work to
be done if the quote was acceptable.
- Road needs attention on Tamworth Road by
the Islington development following the building work–County
Highways reported that the work was completed but rather than raise
the bus stop slab they have put in an edging kerb to prevent mud
getting onto it. Councillor A Lewis reported that the verge is
still a mess and the edging stones will not solve the problem as mud
will still come down the hill and onto the bus stop area. The Clerk
will follow this up.

Can we look into funding to replace the bench in
Piccadilly that was demolished in a car accident? – There does not
seem to be any spare money from the Area Forum Fund as it is all
allocated. This was discussed and agreed that the previous bench was
well used. It was proposed by Councillor B Moss and seconded by
Councillor A Lewis and agreed by all:-
RESOLVED: That the Clerk would order a new
bench for Piccadilly the same as the one we recently put opposite the
water park in Kingsbury. The cost is approximately £850.00.
433 Large lorries driving through
Whateley (412)
Residents are still having problems with large
lorries trying to drive through the narrow roads of Whateley from the
Rush Lane direction, despite the signs that have already been erected at
both entrances to the village. WCC were not convinced that a further
sign positioned just past the Biffa landfill site would solve the
problem but promised to discuss the matter further to see if there are
any alternative ideas to be looked into. Unfortunately WCC or the
Parish Councillors can come up with any further solutions to this
problem. The only way that we can do anything is for us to have number
plates/company names/times of vehicles using the route and report them
to the relevant company.

encroaching onto gardens along Wood Street – WCC Countryside
Recreation met Councillors A Lewis and H Phillips on site to discuss
the problem. The path issue has been referred to County Highways

- Can we ask WCC when the proposed changes to
help awareness of speed on Hurley Common are to be implemented –
It was hoped that the plans would be carried out by Spring 2009 but
a major re-organisation of WCC County Highways has delayed the
process. The scheme will be completed as soon as possible.
435 Noise from EMR on Sundays (416)
A response has been received from EMR confirming
their opening times and they are always closed on Sundays. Normal
working hours are Monday to Friday 7.30am – 17.00pm and Saturday 7.30am
to 12.00pm. They do endeavour to keep the noise levels to an absolute
minimum during operational hours especially at sensitive hours and will
continue to monitor this.
Further issues were raised by Councillors that some
EMR drivers were using the wrong route to and from the site and there
have been numerous lumps of metal on the road particularly recently.
The Clerk will pass this information onto EMR.

The following responses were received from the
relevant authorities:-
- The Edge Hill/Trinity Road signs have been
demolished – These will be repaired shortly.
- The trees/hedges along Edge Hill are
blocking the road signs – These will be cut back.
- Cars are parking in front of the houses by
the school and making it difficult to see to pull out of the school
drive – The police will monitor this. County Highways cannot
put bollards on this because of the verge being mowed by NWBC.
- Parking along Boulters Lane continues to be
a problem – This has been passed onto the Police.
- Parking on double yellow lines in Sycamore
Road and parking in the turnaround area in Elm Tree is causing
problems – The police have been informed and will monitor.

Park (374)
The work has still not been started. This involves
raising the height of the hand rail along the side of the steps,
erecting a section of metal fencing at the point the path crosses the
brook close to the bottom of the steps and to surface a small section of
T27. WCC have given the order to the contractor and told them to carry
the work out as soon as possible. WCC will contact the contractor again
to get a date for the work.
399 When will power be restored to the
lamps in Hurley Common? (375)
The reconnection of service took place on 11th
May 2009.
400 ‘Black Path’ (376)
WCC have suggested to NWBC that chicanes are
created at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads. A cost has been requested for the chicanes by NWBC which is
still awaited but the Parish Clerk had made a general enquiry to a
company and was asked to find out if the quote received of £530 + VAT
included fitting as well as supply.
401 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (377)
Unfortunately the plan, design and costs for the
proposed play area have still not been received. It is now hoped to
have the results in time for the next parish meeting. The Clerk has
sent numerous letters asking for part or all of the £5,500 that we need
to raise as third party funding. This is a requirement of the
application for funding. Three responses have been received with only
one small amount pledged so far. The Clerk will continue the pursuit of
the third party funding. Also NWBC are looking into this for us.
402 Piccadilly Play Area (378)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. NWBC
have said that when the contractors commence work on the Atherstone
project they will ask them to come and look at this to see what can be
done.
403 Adoption Scheme - Red Telephone
Kiosks (379)
The Adoption of the Kiosk is now nearly complete.
BT will remove the telephone equipment and the Clerk is waiting for a
quote for the disconnection of the power supply. A sign also needs to
be put in the kiosk stating that it is no longer BT owned.

Repairs have just been carried out on the bus
shelter and it is used by many residents. PCSO G Scott suggested that
the bus shelter could be painted by community helpers if we supplied the

The post box is now open and is in a wall by the
same property as it used to be.
406 Grit Bin request for Ferndale Close
in Hurley (382)
Unfortunately there is no record of Ferndale Close,
Hurley in the official register (The Gazetteer) so it would appear to be
un-adopted highway, therefore a private drive and we would not be able
to put a grit box on a private road. WCC have had no approach from the
developer to adopt this road, but looking at the layout it is not laid
out to adoptable standards and so will remain private.

The Bus Information Point is in place and the
damaged board in the nearby bus shelter has now been removed.

An application for a donation on behalf of SSAFA
(Soldiers, Sailors, Airmen and Families Association) for a charity cycle
ride has been received. The Clerk explained about the conditions for a
Parish Council when donating to various charities and that they must be
to benefit people residing in the UK only. Following further
information gained, it would be possible to give a donation to be used
for the benefit of the local area. It was proposed by Councillor H
Phillips and seconded by Councillor B Moss and agreed by all that
RESOLVED: that a donation of £200.00 be given
with the stipulation that it should go to the North Warwickshire office
of the charity to benefit the local community.

The following replies have been received from the
relevant authorities:-
- Car Boot sale by Lea Marston. Marshalls
are illegally stopping traffic on the main road – This was
reported to the police but is still ongoing. Further information
will be reported to the police.
- Tree roots are cracking up the pavement and
encroaching onto gardens along Wood Street – WCC have offered to
meet on site to discuss the problem. This to be arranged.
- Lorries are churning up the grass verges on
Knowle Hill/Atherstone Lane – This area has a very good safety
history so additional engineering would not be possible. Any
information gathered on the speeding lorries could be given to WCC
and looked into.
- Pot holes by the entrance to Kingsbury
School need repairing again – These will be filled again but WCC
are only able to carry out temporary repairs because of resources
problems at this time.
- Following gas pipe repairs a blossom tree
has gone, will it be replaced – Reinstatement of the verge
following the repairs has now been done and it has now been
clarified that there is not a missing tree.
- Speed sign opposite Church Lane is not
working – This has been reported but may take a couple of weeks
to get repaired as specialist contractors have to be deployed.
- Can NWBC provide a salt bin for St Michaels
Close? – This was proposed by Cllr A Lewis and seconded by Cllr
B Moss and agreed by all
RESOLVED: to purchase
a grit bin as it is not NWBCs responsibility to provide one. County
Highways will then site it and fill it for us.
- A ‘village shop’ sign is requested for
Knowle Hill opposite Bridge Street – The County Council does not
provide road direction signs on the public highway for private
premises. They felt most users would be local anyway and they have
to restrict the amount of signs put up.
- Can we ask WCC when the proposed changes to
help awareness of speed on Hurley Common are to be implemented –
A reply is awaited.

416 Noise from EMR on Sundays
Residents have asked if the noise from the site on
a recent Sunday is allowed as they would like at least one day a week
that was peaceful. The Clerk will write to EMR and ask that they avoid
early on Sundays and show a bit of consideration for their neighbours.
417 Range Way problems with litter and
nuisance youths
Following an incident attended by police and a call
from a resident concerned about the increase in litter and youths
hanging around the alleyway in Range Way, the issue of a bin was
mentioned. It was thought that the alleyway was too narrow for a bin
and the situation would be monitored and if it continued the possible
closure of the alleyway could be explored at a future date but only if
it was acceptable to the local residents.

Councillor I Thomas reported that a piece of land
has been acquired but planning permission has to be gained in order to
build a wall to put the box in. No application has been received so
Councillor I Thomas will liaise with Mike O’Brien MP to follow this up
as he was originally informed that a new post box would be installed
before the old one was removed.

386 Legal Diversion of Public Footpath
T47 (367)
The legal line of a path is obstructed by a pond
but also crosses a section of the brook that is far too wide to be
bridged. WCC have the landowner’s permission for it to be diverted onto
an existing bridge but this needs improvement work. Councillors agreed
to send a letter of support for the application to speed the process up
and get the path open and available more quickly, after discussing the
explanations from WCC to the previously raised questions.

The following replies have been received from the
relevant authorities:-
- Bottles and clothes from the Kingsbury
bottle banks are being strewn around – When the banks get full
they should be reported to NWBC and will be emptied. They need to
be monitored to see if there should be an increase in the emptying
cycle.
- Road under the bridge at Piccadilly is in
need of repair and the damaged kerb stones are getting worse –
The pot holes under the bridge will be repaired but the kerb stones
need some permanent measures to avoid it happening again and at
present there is no funding for this.
- Can we look into funding to replace the
bench in Piccadilly that was damaged in a car accident? – We
need to wait until after the next Area Forum West meeting to see if
there are any funds available. The Grass Roots Fund has been ruled
out as it does not donate to Parish Councils.
- The manhole cover opposite the entrance to
the Methodist Church needs attention – This has been reported to
STWA and should be repaired very soon.

389 Charity Cycle Ride
An application for a donation on behalf of SSAFA
(Soldiers, Sailors, Airmen and Families Association) for a charity cycle
ride has been received. The Clerk explained the conditions imposed on
Parish Councils when donating to various charities and that they must be
to benefit people residing in the UK only. Further information would be
gathered for the next meeting before a decision is made.
390 Large lorries driving through
Whateley
Residents are still having problems with large
lorries trying to drive through the narrow roads of Whateley from the
Rush Lane direction, despite the signs that have already been erected at
both entrances to the village. Councillor B Moss suggested that one
further sign positioned just past the Biffa landfill site would be all
we could possibly do to stop this. Councillors agreed that the Clerk
should send the latest proposal with photographs to WCC to see what they
think, as a lot of thought had already gone into the best place for
signs to stop this by WCC.

T18 formal notification of proposed stopping up of vehicular rights and

351 Steps and footway into the Water
Park (325)
The work is being arranged for late March so that
the costs will fall in the next financial year. This involves raising
the height of the hand rail along the side of the steps, erecting a
section of metal fencing at the point the path crosses the brook close
to the bottom of the steps and to surface a small section of T27.
352 When will power be restored to the
lamps in Hurley Common? (326)
WCC have now been informed by E-on that the
reconnection of service will take place on 14th April 2009.
353 ‘Black Path’ (327)
WCC have suggested to NWBC that chicanes are
created at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads. WCC say that the two small lengths of path are not on the
definitive paths list and therefore not their responsibility. A cost
has been requested for the chicanes by NWBC and the Parish Council so
they know how much is needed and can look into possible funding.
354 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (328)
NWBC have received completed ‘picksheets’ from some
local groups but it was felt that not enough groups had been consulted.
Other groups in Kingsbury were suggested to ensure forms were received
from all ages from ‘tots to teens’ and Councillors, the Clerk and NWBC
will arrange for these to be consulted. It is hoped to have the results
in time for the Play Company to design the play area, based on the local
preferences, and cost it out in time for the next parish meeting.
355 Proposed Household Waste
Recycling/Transfer Centre (329)
At the WCC Regulatory Committee meeting in February
there were many issues still to resolve and the application will now be
discussed in July.
356 Piccadilly Play Area (330)
The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off. NWBC
have no funding at present for this but it was suggested that the
contractor should sort this out. The Clerk will liaise with NWBC.
357 North Arden Heritage Trail project

The North Arden Heritage Trail project launch
meeting on 26th February, was well attended. General
information and all about the project can be found on the website
www.northwarks.gov.uk/ardentrail There is also a free Stone Carving
Workshop at Nether Whitacre Village Hall on Saturday 21st
March.
358 Adoption Scheme - Red Telephone
Kiosks (333)
BT have now received authorisation from NWBC to
allow adoption of the kiosk. In order to process the application an
‘Adopt a Kiosk’ agreement form needs to be completed. The Clerk has
been advised to get the legal section to look over the agreement before
signing.
359 Councillors Parish matters raised

The following answers have been received from the
relevant authorities:
- No street lighting along the path between
the houses at Piccadilly – WCC have confirmed that the footpath
in Piccadilly is maintained by them so they would be able to
install/own/maintain additional street lighting if they can find the
funds. The cost would be in the region of £3,500 as there is no
power running along the footpath. It will be put on the improvement
request list, which is capital funded. WCC suggested trying the
County Councillor to see if he has any funds available, but
unfortunately these are all allocated.
- The lamp is out on the Central reservation
at the southern entrance to Mill Crescent – This has been fixed
but the reason the hatpins are always on continuously is due to cost
effectiveness (the type that switch off have a high cost of repair)
and if the weather is overcast they can still be seen.
- A panel is missing from the Wood End bus
stop – The damage has become worse than first reported and
Queensbury Shelters considered it debatable whether it would be
worth repairing after looking at photographs taken of the damage.
The Clerk asked a local workman who had done work for us on the Mill
Crescent shelter to look at it. He found some of the panels thrown
in the hedge and has quoted around £300.00 for the repairs using the
old Perspex panels. It was proposed by Cllr A Lewis and seconded by
Cllr J Thomas and agreed by all:
RESOLVED: The repairs
to the shelter be carried out with the cost in the region of £300.00 and
that in the future it could be looked into replacing the shelter.
- Up-to-date copies requested of the Local
Definitive footpath maps – WCCs Access Information officer has
explained that the maps are subject to copyright and she has sent a
copy to the Clerk. The copy will be brought to meetings so that any
matters arising to do with footpaths can be clarified.
360 Piccadilly Post box removed (337)
A new post box should have been installed before
the old one was removed. Royal Mail is looking into this. Councillor I
Thomas reported that a piece of land has been acquired but planning
permission has to be gained in order to build a wall to put the box in.
361 Grit Bin request for Ferndale Close
in Hurley (339)
Unfortunately there is no record of Ferndale Close,
Hurley in the official register (The Gazetteer) so it would appear to be
un-adopted highway, therefore a private drive and we would not be able
to put a grit box on a private road.
362 WCC - Bus Information Points (340)
The County Council are carrying out a programme of
installing Bus Information Points (BIPs) in Towns and larger villages.
The initiative is part of the Warwickshire Local Transport Plan
2006-2011. The BIP consists of a bus route map and essential
information such as various contact details. Councillors B Moss, M Moss
and C Ayasamy met a representative from WCC to discuss the site for the
Kingsbury BIP. It will be positioned on the slope towards the shops at
Jubilee Court.
363 Request for funding – Hurley Kings
Football Club (342)
Hurley Kings football club have thanked the Parish
Council for the donation towards new kits for two new age groups and
they have looked into putting the parish logo/name on the shirts but the
cost would be another £100.00. This was discussed and it was
unanimously decided not to go ahead at this stage with the extra cost as
funds are being allocated for other projects.
364 Community Speed Watch (343)
The Community Speed Watch scheme provides an
innovative solution to enable local communities to actively take control
of their problem speeding areas in partnership with the Borough Council
and the Police. The scheme involves members of the public volunteering
their time to raise awareness of the dangers of speeding and record
motorist speeds. Councillor C Ayasamy is in the process of collecting
signatures on Sycamore Road, Kingsbury and needs 200 and at least 6
volunteers for the scheme to get underway.

The following replies were received from the

- Pothole Sycamore Road – This has been
filled in.
- Settee dumped at the Tamworth end of
Kingsbury – This has been removed
- Path edges need trimming on the Church Road
recreation ground – NWBC say that this is not covered in the
regular work, but they can quote for a one-off or annual trim and
add it to the schedule. The Clerk to get a price for the next
meeting.
- Road needs attention on Tamworth Road by
the Islington development following the building work – County
Highways are planning to build up the verge when the weather
improves. Councillor A Lewis pointed out that the bus stop would
also need raising and the area is in need of cleaning.
- Piccadilly side of the lights there is a
fridge and a litter pick is needed – This has been removed and
tidied.

367 Legal Diversion of Public Footpath
T47
The legal line of a path is obstructed by a pond
but also crosses a section of the brook that is far too wide to be
bridged. WCC have the landowner’s permission for it to be diverted onto
an existing bridge but this needs improvement work and the legal process
to reduce the landowners liability. A letter of support for the
application is being asked for from the Parish Council to speed the
process up and get the path open and available more quickly.
Councillors have asked the Clerk to find out why a diversion order
wasn’t sought when the pond was put in and when it was built before
discussing it further.

323 Public Questions
A Kingsbury resident attended the meeting on behalf
of local residents to ask for help with providing a fence to improve the
security around the Sycamore Road play area and for the safety of the
children. Residents are trying to raise money to fund the project.
Councillors agreed in principle that this was a good idea but suggested
trying the Area Forum Fund and North Warwickshire Borough Council first
to see if any funding could be secured and then to come back to the
Parish Council when a more definite figure is known.

section of T27 (the path which runs at the back, close to its junction
with T26 where a large puddle forms in wet weather).
326 When will power be restored to the
lamps in Hurley Common? (304)
The new pole bracket and lantern were installed
just before Christmas. WCC have now placed an order with E-on for the
reconnection of service. This should have been completed by the end of
February.
327 ‘Black Path’ (305)
A section of hedgerow on the Hurley ‘Black Path’
T53 needs cutting back. Representatives from WCC, the Tenant Farmer and
a local Arboricultural contractor met on site to inspect the path. Fly
tipping in the area was reported to NWBC and the work to remove the
overgrowth to the footpath and allow free passage by pedestrians has
been ordered. Later in the year the thorns and briars will be removed
to create a ditch to prevent access onto farmland and also the knotweed
will be sprayed.
WCC have suggested to NWBC that chicanes are
created at the two points where they leave Meadow Road and Hawthorn
Avenue, Hurley so as to prevent access by motorcyclists and those using
quads. The responsibility for this is being looked into.

us in the February half term week and the following week. Various local
groups and the Primary School will be consulted. The Clerk has asked

332 Dog Bins for Piccadilly (312)
NWBC are aware that there are no dog bins in
Piccadilly and that the bin is being used by the recreation area but
have no funding left for this year. It is noted for next financial year
but in the meantime if there are any problem areas the dog warden can be
informed to visit more frequently.

stop – A quotation was received from Queensbury Shelters, but
the damage had increased. The Clerk will look into further quotes
for the repairs.
- Excessive dog mess on Trinity Road –
The Dog Warden has requested a more specific area and this will be
passed on.
- Car parking behind shops in Jubilee Court
and blocking the shop entrances – This has been sorted out by
the police.

337 Piccadilly Post box removed
The post box has been removed now that the Post
Office has closed. A new post box should have been installed before
this happened. The Clerk has reported this to Royal Mail and has had a
response to say it is being looked into.
338 Trinity Road low bridge
Concerns have been raised by a resident about the
lorry problems and the low bridge. This is an ongoing problem and the
Parish Council is working with WCC and the companies on Kingsbury Link
to try and ease the problem. An up-to-date response detailing the ideas
being looked into and the reasons why they would or would not improve
the situation was received from WCC and copied to all including the
resident who raised the problem.
339 Grit Bin request for Ferndale Close
in Hurley
Following the bad weather and icy conditions
requests for a grit box to be placed in Ferndale Close, Hurley have been
received from residents. Councillors first asked the Clerk to find out
if the road was adopted or private.

The quote for Grounds Maintenance Services
2009-2010 has been received from NWBC. This includes work to the
Kingsbury Recreation Ground, Wood End Youth Centre and footpaths in
Kingsbury, Wood End and Hurley etc. It was proposed by Councillor H
Phillips and seconded by Councillor I Thomas and agreed unanimously:-
RESOLVED:- The NWBC Grounds Maintenance quote
for 2009/2010 be accepted.
342 Request for funding – Hurley Kings
Football Club
Hurley Kings football club have requested help
towards new kits for two new age groups and/or waterproof jackets for
other teams. This was discussed and it was proposed by Councillor I
Thomas and seconded by Councillor B Moss and agreed
RESOLVED: That £300.00 would be donated to go
towards football kits for the two new age groups. It was also suggested
that the Clerk find out if the Parish name could be put on the kit as
sponsors.

The issue of possible refuges for Tamworth Road, Kingsbury was raised
at the September 2008 meeting. The County Councillor has requested a
feasibility study which has been approved, but no time scale has been
given. The outcome will be reported on when the results are received.
302 Minutes
The amendment to Minute 264 on the 15th October minutes
was signed by the Chair.
It was proposed by Cllr H Phillips and seconded by Cllr M Moss and
agreed by all:
RESOLVED: That the minutes of the meeting held on 19th
November 2008 are approved as a true record.
303 Steps and footway into the Water Park (281)
WCC have now met with the contractor to look at raising the height of
the hand rail along the side of the steps, to erect a section of metal
fencing at the point the path crosses the brook close to the bottom of
the steps and to surface a small section of T27 (the path which runs at
the back, close to its junction with T26 where a large puddle forms in
wet weather).
The quote for the work is expensive and as the end of the financial
year is nearing, the work is being arranged for late March so that the
costs will fall in the next financial year.
304 When will power be restored to the lamps in Hurley Common?

The new pole bracket and lantern were installed just before
Christmas. WCC have now placed an order with E-on for the reconnection
of service. This should be completed by the end of February.
WCC also reported that E-on have replaced one of their wooden poles
on Hurley Common and could not reattach the pole bracket as it was
damaged when they removed it. This is believed to be lamp post number 10
between the public house and Yew Tree Cottage. This means that a new
pole bracket will have to be ordered and fitted and the service
reconnected by E-on which could take up to three months.
305 ‘Black Path’ (283)
A section of hedgerow on the Hurley ‘Black Path’ T53 needs cutting
back. NWBC have also reported this to Countryside Recreation to get the
necessary work done, but despite reminders we are still awaiting a
response from WCC.
306 Proposed Play Equipment-K’bury Recreation Ground, Church Lane
(284)
NWBC have offered to conduct the consultation for us in the February
half term week and the following week. Various local groups and the
Primary School will be consulted. The Clerk to discuss with NWBC the
groups they have listed and report back to Councillors. The final
timetable of consultations can then be advertised on our website and
around the village and any Councillors that wish to attend the sessions
can.
Also a final copy of the proposed choices for the play area equipment
‘pick sheet’ was passed round and it was proposed by Councillor A Jenns
and seconded by Councillor B Moss and agreed that:
RESOLVED: NWBC would be asked to print the pick sheet for us as
previously agreed with them and asked to undertake the consultation
process on behalf of the Parish Council as offered
307 Proposed Household Waste Recycling/Transfer Centre (285)
The revised site information received before Christmas did not alter
any of the concerns of the increase in traffic using the village roads.
The Parish Council again sent a statement of objections to WCC to be
considered when the application goes to the Planning Committee in
January 2009.
At this meeting, NWBC objected and it will be discussed again at the
Regulatory Committee in February.
308 Piccadilly Play Area (284)
The gap by the ‘kissing gate’ left by the contractors when fitting
Piccadilly play area needs blocking off. The Clerk will again raise this
with NWBC.
309 Notice Board for Kingsbury (287)
There is now a Parish notice board in Kingsbury Library which can be
seen from the windows even if the library is closed. Notices, dates of
meetings and general information will be displayed.
310 North Arden Heritage Trail project (292)
The North Arden Heritage Trail project is about to be moved forward
to our community. There was a launch meeting planned for Tuesday
February 3rd but this had to be cancelled due to the weather.
It has been rearranged for 26th February and it is hoped to
involve as many groups/residents as possible to help with the scheme.
One activity, stone carvings, can be made at workshops by local
residents and placed along the trail. General information and all about

Also information will be on the parish website.
311 Kingsbury Hall planning application (293)
NWBC could not accept representations after our January meeting for a
planning application proposing properties to be built on Kingsbury Hall
site. A statement was produced and circulated to all Councillors for
approval. Although not against the application Councillors were
concerned about the access to the development via a narrow privately
owned track and observations were sent to NWBC in time for the deadline.
The application was approved in principle at a meeting in January
2009 and would be built in phases.
This raised the issue of whether the Parish Council should meet in
December, but it was generally felt that the meeting timetable should
remain the same.
312 Dog Bins for Piccadilly (294)
NWBC only install dog bins in recreation grounds not streets. They
are aware that there are none in Piccadilly but have no funding left for
this year. It is noted for next financial year but in the meantime if
there are any problem areas the dog warden can be informed to visit more
frequently. Councillor Thomas pointed out that the only litter bin in
Piccadilly is by the children’s play area and this is being used to
dispose of dog mess. This will be reported to NWBC.
313 Adoption Scheme - Red Telephone Kiosks (295)
The adoption of the Whateley phone box is going through. The Clerk
has been advised to get the legal section to look over the agreement
before signing.
314 Notice boards (296)
As agreed at the last meeting the first board is to be shared
by the Parish Council and Kingsbury Swimming Pool and is now up
in the school entrance to the pool.
Hurley Community Association and the Parish Council’s logo
will be put on a new board for outside the Village Hall. This
will help to advertise all local events and notices including
parish ones.
315 Review of Effectiveness of Audit (297)
A meeting is required once a year to review the accounts procedures
for audit purposes. The Chair, Vice-Chair and Clerk met in January to
discuss this. The outcome was that system of accounting and the
procedures in place by the Internal Auditor and the Clerk are more than
satisfactory and there is no cause for any changes to be made.

317 Council Taxbase and Precept Requirements for 2009/2010
Councillors considered a report provided by the Clerk, based on
current expenditure and estimated out-turn for 2008/2009. Councillors
discussed this at length and it was proposed by Councillor H Phillips

RESOLVED: That an expenditure budget of £29,000 be approved for the
year 2009/2010, and that the precept levy on North Warwickshire Borough
Council would remain the same as last year at £29,000.

A planning application has been lodged by NWBC to build two new
dwellings on this piece of land. Councillors strongly object to this and
an objection statement will be forwarded to NWBC.

The following issues were raised by a member of the

- Are refuges for Tamworth Road, Kingsbury a
possibility?
There is a fund that the
County Councillor can bid from to get a feasibility study done for works
that fall outside the normal funding streams (ie casualty reduction
funding). This has been requested.
- Wooden bus shelter in Kingsbury is
damaged/rubbish in roof space.
NWBC inspected the
shelter and a rough price to repair the shelter was £1000.00 with the
risk of further work needed within 12 months. The structure is safe but
not watertight. It was unanimously agreed, due to the excessive cost
involved, that it would be looked at again at a later date.

RESOLVED - That the minutes of the meeting held
on 17th September 2008, are approved as a true record subject
to a change in wording of minute 264 – Proposed Play Equipment Kingsbury

‘kick about wall’ as part of the teen provision).
280 Speeding vehicles in Hurley (259)
WCC have now looked at the points raised by
residents at the public meeting and put together a proposed scheme to
combat speeding in Hurley Common. Parish Councillors are keen for the
scheme to be implemented and WCC can now progress to the formal
consultation stage. Local residents can read the response from WCC and
see the latest proposals by checking the Hurley page of the website
www.kingsburyparishcouncil.co.uk
It was proposed by Councillor I Thomas and seconded
by Councillor A Lewis and agreed by all that:-
RESOLVED: Kingsbury Parish Council agrees to
the proposed scheme to try to help reduce the speed of vehicles
travelling through Hurley Common. WCC will be informed so that they can
move the process forward to the formal consultation stage.
281 Steps and footway into the Water
Park (260)
WCC are meeting the contractor in December to look
at the hand rails on Public Footpath T26 and whilst on site they will
ask them to undertake a small surface repair on T27 at the rear of the
school, at the start of the path close to the church. This work should
have been looked into when the contractors were on site repairing the
flood walk.
282 When will power be restored to the
lamps in Hurley Common? (262)
WCC are waiting for Carillion to fit a new
bracket. It is hoped that it will be installed on site by the end of
November and connected by E-on a month or so after.
283 ‘Black Path’ (263)
A section of hedgerow on the Hurley ‘Black Path’
T53 needs cutting back. NWBC have also reported this to Countryside
Recreation to get the necessary work done. We are waiting for a
response. Councillor Simpson also commented that the hawthorn bushes
are now obstructing the path. This will be passed onto WCC.
284 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (264)
Another meeting of the sub committee with NWBC was
held in November. Concerns were being raised by the Police Force
Architectural Liaison Officer and NWBC that the site did not have
natural surveillance ie not well overlooked and this was a safety issue
if putting teen equipment on the site.
Other options were discussed and considered. One
option was to have the younger site on the recreation ground and the
older children’s site behind the Youth Centre but there were many issues
to look into as this site was not a parish council site and again does
not have natural surveillance. It was decided to explore the
possibility of this option and meet again in two weeks with the
results. If the findings were not satisfactory then we would continue
with the original plan and the lighting issue would be looked into.
285 Proposed Household Waste
Recycling/Transfer Centre (266)
Great concern has been raised by local people to
this proposed site, mainly of an increase in traffic using the village
roads if this centre goes ahead. The Parish Council has sent a
statement of objections to WCC to be considered when the application
goes to the Regulatory Committee in January 2009.
Some revised site information has since been
received and will be looked into to see if it addresses any of the
concerns.

Lamp No 19 out (Tamworth Road-opposite Smith St)
– WCC say that two new lamp columns in Wood End should now be
working and the old column will be removed in the next couple of weeks.
The Church sign has been put back on the lamp post.
289 Freedom of Information Act-New model
publication scheme (273)
Under the Freedom of Information Act 2000 the
Information Commissioner was under a duty to review the model
publication schemes. This is now complete and the adoption of the new
scheme by parish councils must take place before 31st
December 2008.
Councillors had copies of the new scheme to look at
prior to the meeting. This was discussed and costs decided on. Some of
the information would be on the website and the rest that is applicable
to Kingsbury Parish Council obtainable from the Clerk. It was proposed
by Cllr A Jenns and seconded by Cllr H Phillips and agreed by all:-
RESOLVED: Kingsbury Parish Council have adopted
the Freedom of Information Act - New Model Publication Scheme. Costs
for photocopying will be 20p per sheet with a minimum charge of £1.00
and postage at the current cost.
290 Councillors Parish matters raised –
October (274)
The following responses have been received from the
relevant authorities:-
- Numerous pot holes were reported - by the
entrance to Kingsbury School, junction of Piccadilly Way, Pear Tree
Road, junction of Tamworth Road/Trinity Road and junction of
Sycamore Road – These have all been added to the list when the
weather gets a bit drier.
- The path Elm Tree to Trinity Road is in bad
condition – This will be repaired as necessary in the next
couple of weeks.
- Sunken manholes in Wood End – They are
safe and County Highways believe they belong to Severn Trent.
- Crack in the path at the base of lamp post
by 21 Mill Crescent – This is being looked into by the Street
Lighting Group as the column may need resetting.
- ‘Dent’ in the road, Sherwood Close –
This will be reinstated.
- Trees in Edge Hill are obstructing the
lights – This has been passed onto the Tree Inspector.
- Markings on speed humps in Knowle Hill are
faded – This years white lining programme has now been completed
but this will be added to next years programme.
- Tree cut down by Kingsbury Library – is it
going to be replaced? – The Forestry section of WCC did not know
of this tree being removed. If they find any more information out
they will report back.
- Recycling bins are overflowing at Kingsbury
– These have been reported to NWBC who will arrange a collection.

293 Kingsbury Hall planning application
Councillor B Moss informed Councillors that there
was a planning application going through concerning properties to be
built on Kingsbury Hall site. The Clerk will check whether NWBC can
accept representations after our January meeting. If this is not
possible then a statement will be produced and circulated to all
Councillors for approval.
294 Dog Bins for Piccadilly
Councillor I Thomas reported that there were no dog
bins in Piccadilly. This will be followed up.
295 Adoption Scheme - Red Telephone
Kiosks
The Whateley phone box is on the list for proposed
removal due to lack of use. The residents of Whateley would like to
keep the telephone kiosk as it is a village landmark. There is a scheme
to ‘Adopt a Kiosk’ once the phone has been disconnected if the
local/parish council apply to take ownership of the kiosk. The Clerk
has looked into this and explained the system to Councillors. A
decision needs to be made whether to pay and have the electricity supply
removed or pay the minimum bill for supply to the box. This was
discussed at length and proposed by Councillor B Moss and seconded by
Councillor H Phillips and agreed by all:
RESOLVED: Kingsbury Parish Council will apply to
adopt the kiosk and pay for the electricity supply to be removed. A
quote for this to be obtained from Energy Services.
296 Request for contribution towards
notice boards
Two requests have been received for help to
purchase notice boards:-
- The first is from Kingsbury School/Kingsbury
Swimming Pool. It is proposed to put two notice boards in the
entrance to the swimming pool. One for the school to use and the
other to be shared by the pool and the Parish Council. The cost of
one board is £231.00. The school will pay for one board and they
are asking for assistance to pay for the other.
- Also Hurley Community Association is asking
for £345, the shortfall on the grant they have received towards a
new board for outside the Village Hall. This will help to advertise
all local events and notices including parish ones.
Both requests were discussed and it was proposed by
Cllr H Phillips and seconded by Cllr A Lewis and agreed by all:-
RESOLVED: £231 will be given to Kingsbury School
and £345 to Hurley Community Association for new notice boards.

Cllr B Moss and the damage seems to be from vandals. The Clerk was
asked to see if NWBC could give us a price to repair it.
- Road sweeper in Hazelcroft still not
cleaning out the gutter satisfactorily.
A small compact sweeper
has been deployed to cleanse the cul-de-sac and an inspection has taken
place by a member of staff from NWBC and Enterprise PLC (the
contractor). The road is predominantly clean. NWBC asked that any
further problems should be phoned in to NWBC by residents as NWBC are
then duty bound to get back to them directly and all problems are
logged.
- Can the 30mph speed limit be extended on
Trinity Road to past EMR?
This is a ‘C’ class road
and WCC are currently undertaking a feasibility project on reviewing ‘C’
class roads. This would fall under the review if it is approved and WCC
will contact the Parish Council when this happens. WCC are currently
implementing new speed limits identified under the ‘A’ and ‘B’ class
roads review.
No further questions were raised at the October
meeting, but it was pointed out that the hedge by Hazelcroft is again in
need of trimming.

WCC have now put together some plans/information to
combat speeding in Hurley Common which they presented to the public at a
separate meeting on Thursday 23rd October at Hurley
Village Hall.
This was well attended and further points were
raised by residents which will be looked into by WCC and a report will
hopefully be available for the November Parish meeting. Local residents
can keep up to date with any information by checking the Hurley page of
the website

of the meeting will be available on the website after 20th
November)

The contractor has now completed the work to the
walkway and removed the debris from the site. However the work to the
handrail and the further work to public footpath T27 which was supposed
to take place at the same time does not appear to have been done. The
Clerk will follow this up.
261 Kingsbury Swimming Pool (238)
New charges and conditions for the pool came into
effect from 1st September 2008. The charges have gone up
considerably for the Parish swimming clubs to bring the costs into line
with all other pool users, as they were benefiting from greatly reduced
rates. WCC have put forward a programme of staggered increases to help
the clubs, but all pool users must be charged the same rates to be fair
to all users.

WCC were going to order a new bracket and get it
installed before Central Networks could reconnect the supply. To be
followed up yet again!!
263 NWBC – Grounds Maintenance Services

We are still waiting for NWBC to price up the
section of the Hurley ‘Black Path’ T53 that needs cutting back.
Councillor Simpson reported that the hedges on both sides between Meadow
Road exit and Hawthorn Road exit need cutting back. This was passed
onto Countryside Recreation to follow up.

The Parish Council is hoping to contribute to and
get funding to provide some new play equipment for the recreation ground
at Church Lane, Kingsbury.
Another meeting of the sub committee with NWBC will
be set up to plan the consultation process, which is a requirement when
applying for grants. A revised ‘pick sheet’ will be ready for this
meeting showing the choices and options for the equipment. It was
proposed by Cllr I Thomas and seconded by Cllr H Phillips and agreed
that Councillors want to see the ‘kick about wall’ as part of the teen
provision at Kingsbury. This has been very popular at Piccadilly. The
consultation process will hopefully prove this to be the case for
Kingsbury.
265 ‘No lorries’ sign for Whateley (242)
The Parish Council has agreed to pay for a ‘lorries
crossed out sign’ for Whateley to stop the lorries going through the
village. WCC have now got Department for Transport approval for the
sign and are waiting on underground utilities information before
ordering. Once the order is placed it should take between 4-6 weeks to
complete.
266 Proposed Household Waste
Recycling/Transfer Centre (243)
Great concern has been raised by local people to
this proposed site, mainly of an increase in traffic using the village
roads if this centre goes ahead. WCC have carried out a traffic survey
on Tamworth Road and Boulters Lane to establish the volume and type of
traffic using the roads at the present time. This was requested by the
Parish Council and the results reported to a meeting at NWBC by Cllr
Phillips. The Parish Council has sent a statement of objections to WCC
to be considered when the application goes to the Regulatory Committee
in January 2009.
267 Councillors Parish matters raised –

The following replies have been received from the
relevant authorities:-
- Can the emergency evacuation plan be
distributed to the residents of Piccadilly? – Spare notices were
obtained and then distributed by local residents for which we are
grateful.
- The gap by the ‘kissing gate’ left by the
contractors when fitting Piccadilly play area needs blocking off
– NWBC will look into this at some point.
268 Notice Board for Kingsbury (248)
Kingsbury Library has agreed to have a parish
notice board inside the library where it can be seen from the windows.
This may take a few weeks to be delivered.
269 Uneven footpath reported on Tamworth
Road, Kingsbury (249)
WCC say the Tamworth Road footpath can only be
improved by ripping it up and relaying it to new profiles and this is
out of the question financially. They recently installed a drain in the
footway where the worst standing water occurred, but there is little
more they can do from a maintenance point of view at the present time.
It has now been confirmed that this is on a list for reconstruction but
no time scale could be given.

- Lamp No 19 out (Tamworth Road-opposite
Smith St) – The lamp has been replaced but the Church sign has
now disappeared from the lamppost.
- Brick Kiln Lane hedges/brambles need
cutting back – An order has been issued to cut the brambles and
hedge.
- EMR – ‘Pecker’ being used again early in
the morning–This was a short term use and NWBC was notified.
NWBC have requested more notice in the future so that noise tests
can be carried out. Time restrictions will also be in place.

publication scheme
The adoption of the reviewed scheme has to be done
by 31st December 2008. The Clerk handed out copies and
explained what needed to be decided and asked Councillors to look
through the document for the next meeting so that it could be discussed
and adopted at the November meeting.

Meeting of Kingsbury Parish Council held on
Wednesday, 17th September 2008, at Piccadilly Community
Centre, Piccadilly.

232 Declarations of Personal and
Prejudicial Interests
- Councillors A Lewis and H Phillips declared a
personal interest in any Borough Council issues.

233 Public Questions
The following issues were raised by a member of the
public:-
- Can the Council follow up the possibility of
getting refuges for Tamworth Road, Kingsbury?
- Litter bin for new Kingsbury bus shelter in
wrong place – see minute 235.
- Inside of Wooden bus shelter in Kingsbury is
damaged and litter left in roof space.
- Road sweeper in Hazelcroft still not cleaning
out the gutter satisfactorily.
- Can the 30mph speed limit be extended on
Trinity Road to past EMR.
234 Minutes
It was proposed by Cllr I Thomas and seconded by
Cllr C Ayasamy and agreed by all:
RESOLVED - That the minutes of the meeting held
on 16th July 2008, are approved as a true record.
235 Litter bin for Kingsbury bus stop
(213)
Despite NWBC showing the contractors exactly where
the litter bin should be sited, it has been put on the opposite side of
the road. NWBC are in the process of getting this put right.
236 Speeding vehicles in Hurley (214)
It was agreed by Councillors and a WCC
representative to try and use road markings and signs to make the 40mph
limit work better, as it does not seem possible at the present time to
get the limit reduced to 30mph due to various restrictions. WCC have
now put together some plans/information to present to the public at a
separate meeting. This has been arranged for Thursday 23rd
October just drop in between 6pm and 8pm at Hurley Village Hall.
Any comments are welcomed by WCC before the proposals are put forward
for approval. This will be advertised on the parish website (www.kingsburyparishcouncil.co.uk),
around the village via the HCA newsletter, and in the Tamworth Herald -
Village Voice section.
Hurley was not on the recent ‘Proposed review of
changes to speed limits in North Warwickshire’, which was received in
July 2008, because this was only a review of ‘A’ and ‘B’ class roads.
237 Steps and footway into the Water
Park (217)
The contractor has promised on a number of
occasions to get this work started. WCC have been following this up
with the contractor and the date has now been confirmed as the first
week in October.
The public footpath T27 is in need of more work and
WCC will get this checked out and arrange for the contractor to repair
this at the same time.
238 Kingsbury Swimming Pool (218)
New charges and conditions for the pool use came
into effect from 1st September 2008. WCC are proposing to
put up the charges considerably for the Parish swimming clubs to bring
the costs into line with all pool users. They have put forward a
programme of staggered increases to help the clubs and have now informed
them of these. The clubs have raised their concerns about the charges
with WCC and are awaiting an outcome.
239 When will power be restored to the
lamps in Hurley Common? (219)
WCC were going to order a new bracket and get it
installed before Central Networks could reconnect the supply. To be
followed up yet again as no further update was available at the
September meeting.
240 NWBC – Grounds Maintenance Services
(220)
We are still waiting for NWBC to price up the
section of the Hurley ‘Black Path’ T53 that needs cutting back.
Councillor Simpson reported that the hedges on both sides between Meadow
Road exit and Hawthorn Road exit need cutting back. This will be
followed up.
241 Proposed Play Equipment-K’bury
Recreation Ground, Church Lane (221)
The Parish Council is hoping to contribute to and
get funding to provide some new play equipment for the recreation ground
at Church Lane, Kingsbury.
A site meeting was held in August between NWBC,
Parish Councillors and ‘HAGS’ to discuss what equipment and options
would be suitable for the site. The Clerk showed Councillors a colour
chart which HAGS had drawn up with various pieces of equipment and the
costs. It was agreed that the next stage was to set up a meeting of the
sub committee with NWBC to plan the consultation process, which is a
requirement when applying for grants.
242 ‘No lorries’ sign for Whateley (223)
The Parish Council has agreed to pay for a ‘lorries
crossed out sign’ for Whateley to stop the lorries going through the
village. An estimate of the cost for this would be £930-£1200 depending
on the number of posts required and sizes of the signs. WCC have now
got Department for Transport approval for the signs and have to make a
site visit to obtain an accurate price before ordering them.

Proposed Lower House Farm Household Waste
Recycling Centre and Waste Transfer Station. Following a public
meeting where concerns were raised of an increase in traffic using the
village roads, Councillor Phillips has asked the Clerk to see if a
traffic survey can be done on Tamworth Road and Boulters Lane to
establish the volume and type of traffic using the roads at the present
time. This has been confirmed by WCC that it is possible and we are
awaiting a date in the near future for the survey to take place.

The following replies have been received from the

distributed in 2007, but Councillors have asked if it could be sent
out again. The Clerk will follow this up.
- Weeds need trimming by the new bus shelter
in Piccadilly – These will be strimmed.

– NWBC will look into this.
- There will be no place to put parish

into Bodymoor Heath – The 3rd grass verge cut is due
to start very soon.

247 Kingsbury Parish Council
Accounts-Year ending 31/3/08
The completed accounts for 2007/2008 have now been
received back from the External Auditors. The completion notice has
been advertised around the parish as required by the Audit and also put
on the website. There were no items raised for concern.
248 Notice Board for Kingsbury
Councillor A Jenns suggested that we ask Kingsbury
Library if a parish notice board could be put in the foyer of the
library, as it is no longer possible to put notices in the Post Office.
The library has agreed to a notice board standing inside the library
where it can be seen from the windows. The foyer was not suitable on
health and safety grounds. It was proposed by Councillor I Thomas and
seconded by Councillor A Lewis and agreed by all that the Clerk would
order a notice board. The cost would be approximately £100.00.
RESOLVED: A notice board to be ordered at a
cost of approximately £100.00 for use in Kingsbury Library to display
parish notices.

250 Vandalism to Wet Pour surface Church
Lane recreation ground
On the first day of the summer holidays Councillor
M Moss reported that the surface of the flat swing base had been
vandalised. NWBC said that they could carry out the repair but not
until the end of the summer holidays as it would take 6 hours to dry.
The cost would be approximately £135.00. It was agreed by all at the
site meeting (mentioned in minute 241 above) to repair this before it
became a health and safety issue.
251 Money pledged to Kingsbury School
The Parish Council allocated an amount of £5,000.00
to Kingsbury School back in 2006, at the time they were applying for
Specialist School Status. £3754.00 was spent (see minute 688 July
2006). There remains an amount of £1246.00 that has not been claimed.
As this relates to such a long time ago and to enable the Council to
move forward with other projects it was proposed by Councillor H
Phillips and seconded by Councillor I Thomas and agreed by all that:-
RESOLVED: The remaining £1246.00 be withdrawn to
enable the money to be put towards other projects.
