Kingsbury Parish Council Minutes

 Meeting of Kingsbury Parish Council held on Wednesday, 16th November 2011, at Hurley Village Hall, Hurley.

Present:          Councillors:    Chair A Lewis, B Moss, I Thomas, M Moss, H Phillips,

A Simpson, C Ayasamy, J Whitby, J Thomas and A Jenns.

 21        Declarations of Personal and Prejudicial Interests

  • Councillors B Moss, M Moss H Phillips and A Lewis declared a personal interest in any Borough Council issues.
  • Councillor A Lewis and H Phillips declared a personal interest in any minutes concerning Warwickshire CAVA Local Management Committee.
  • Councillor A Simpson declared a personal interest in any minutes concerning Hurley Community Association.

22        Public Questions

There were no public questions raised.

23        Minutes to be Approved

It was proposed by Cllr C Ayasamy and seconded by Cllr I Thomas and agreed:

RESOLVED: That the minutes of the Council meeting held on 19th October 2011 are approved as a true record. 

24        Kingsbury Swimming Pool (4)

We understand that there are still outstanding issues to be clarified before WCC legal department can process the notice on the agreement for Parish pool use. 

25        Play Equipment-Recreation Ground, Kingsbury (5)

The following issues were discussed at this parish meeting:-

·         Fencing/Planting – We have been advised by NWBC that the fencing that we had received a quote for is not suitable for an area by a public footpath and the height would need planning permission.  Councillors discussed other options and the Clerk will get a quote for chestnut fencing to protect the plants whilst they grow. 

·         Litter – There is still a lot of litter that is just being strewn around the site and not put in the litter bins provided, despite the Parish Council purchasing an extra bin.  The emptying day for the bins is Wednesday and NWBC say that this fits into their cycle and it would be difficult to change.  Fixed penalty notices will be issued by the police for anyone caught dropping litter.

·         A statement on the latest situation regarding the issues raised by residents has been sent to NWBC, the police and the residents.

26        Piccadilly Play Area – gap by the ‘kissing gate’ (6)

As budgets are very tight at the moment, NWBC are hoping to secure some assistance with fencing on the back of the development currently taking place. NWBC have spoken to Cllrs I and J Thomas about the situation and any further progress will be reported to us.

27        Proposed closure of Kingsbury Library (7) 

WCC reported that Kingsbury Library proposals have not been accepted at the moment and the current library service will cease on 31st March 2012.  However, discussions with interested parties will continue for the provision of a library service in Kingsbury.

A grant of £3,700 has been awarded to help to retain a library service in Kingsbury and there is a meeting on 21st November to discuss this further. 

28        EMR concerns (8)

Some of the problems with large lorries blocking the entrance to EMR are foreign drivers looking for Kingsbury Link and are not connected with the EMR site.  The company are now passing on any information on other vehicles causing traffic problems so that we can issue this to the companies concerned.

29        Planning Applications (10) 

Former Public Convenience Coventry Road, Kingsbury – Café and Takeaway

This application has been withdrawn.

30        Councillors Parish Matters Raised June (11)

·         Vehicle has ploughed through the verge on Coventry Road and there is now a water problem in the dip – The necessary work has now been carried out.

31        Damage to Wooden Bus Shelter (12)

NWBC attempted to carry out the repairs for us but found more problems with the posts.  Also further damage has been caused and it was decided that Cllr Moss would meet the workmen on site to discuss exactly what would be required to repair the shelter and if it was cost effective to do so.

32        Councillors Parish Matters Raised July (13)

The following responses have been received from the relevant authorities:

·         Can Kingsbury Church car park gate be closed at night? – This request has been sent to the Church and a response chased to no avail.  NWBC and the police have also been informed and were going to speak to the Vicar. We are awaiting an update.

33        Councillors Parish Matters Raised September (14)

The following responses have been received from the relevant authorities:

·         Request for dropped kerb in Wood End by Smith Street-WCC will inspect the location and have asked the Police to deal with inconsiderate parking.  A report is awaited.

34        Meeting with WCC re lorries and low bridge at Piccadilly(15)

The problems caused by lorries getting stuck and having to reverse because they cannot get under the low bridge at Piccadilly are getting more frequent and are still a safety concern.  Meetings have now taken place with WCC and DSV to discuss options to help the situation.  WCC will look into the possibility of a laser flashing light and the Clerk will research whether the Kingsbury Link island could be sponsored by DSV (they would be happy to do this).  This would hopefully help alleviate the problems by putting a direction sign on the island to ensure traffic turns left.  Some decorative planting would also be put on the island.  An update will be reported to the next meeting.

35        Councillors Parish Matters Raised October (17)

The following items have been reported to the relevant authorities:

·         115 Bus timetables for Hurley are not being adhered to by up to 15 minutes – A response is still awaited from Arriva.  To be followed up.

·         Give Way sign past Shell depot needs attention – This has been dealt with by WCC

·         Bromage Path, T27 - Cllr Moss expressed concerns following proposals to convert Kerrycroft, a house on Kingsbury Hall Drive into a nursery. There had been talk of proposals to divert a short section of the public footpath known as the Bromage Path near to where it joins Kingsbury Hall Drive. However on investigating he found that the footpath which is the "walked path" is not in fact on the definitive footpath map but has been in use for as long as anyone could remember. The walked path has been cleared of vegetation and even surfaced with tarmac by WCC, but a revised plan did not indicate any plans to seek a diversion. The proper definitive footpath ran diagonally across garden land in front of Kerrycroft and was currently illegally blocked off.

37        Councillors Parish Matters Raised November

The following items will be reported to the relevant authorities:

·         Damage to Canal Bridge, Bodymoor Heath – Cllr J Thomas asked if any further information was available on this previously reported item.

·         Pot hole by 21 Mill Crescent, Kingsbury – Cllr A Jenns

·         Can we again request if Piccadilly can have a Pelican crossing on Trinity Road– Cllr I Thomas

38        Bus Services

We have heard from WCC that it may be possible to amend the timetable of service 764 to allow journeys between Kingsbury and Hurley to Atherstone.  Councillors were in favour of any extra service following the recent cuts and the Clerk has passed this onto WCC.  Unfortunately, there is a lot of consultation etc that has to be implemented and this means that we are looking at a few months before this is likely to come into effect.

39        Request for a Litter Bin

A resident has asked if a Litter bin could be put at the entrance to the Water Park-Mill Crescent.  NWBC have agreed to empty it but have no funds to purchase one.  This will be put on the agenda for the next Parish meeting.

40        Request for a Memorial Bench opposite Heart of Country Way walk, Hurley

A request to replace an existing bench with a memorial bench and plaque has been received.  As a bench is already on the proposed site, Councillor A Simpson was asked to have a look and see what the state of the existing bench and base is like before we take this further.  To be discussed at the next meeting.

41        NWBC Play Safety – Proposed changes for Parish Councils

NWBC currently provide the Parish Council with a free monthly inspection of our play facilities, but this is to be withdrawn from April 2012.  The letter received detailed various options for the future but a cost is involved.  The options were discussed and it was proposed by Councillor I Thomas and seconded by Councillor A Lewis and agreed by all

RESOLVED: That Kingsbury Parish Council would purchase Option 1 which is a full inspection service at a cost of £137.25 per annum commencing June 2012.

42        Decentralisation and Localism Bill

The Localism Bill has recently completed its passage through the parliamentary process and became the Localism Act in November 2011.  Cllr J Thomas and the Clerk provided some basic information at the meeting to help understand what this will mean to Parish Councils.  There are some proposed forums and information sessions being arranged to help Councils understand the implications of the Act and some Councillors will attend these.  More information will be reported as it is received.

 43        Next Meeting Date

The next meeting will be Wednesday, 18th January 2012 at Wood End Village Hall, Wood End.  The Clerk handed Councillors proposed dates for 2012 meetings and asked if  they could be checked and then agreed at the January meeting.

 4          Kingsbury Swimming Pool (973)

No further update has been received from WCC legal department regarding the process of giving notice on the agreement for pool use.  Therefore, the parish sessions will remain until we have something in writing.

5          Play Equipment-Recreation Ground, Kingsbury (974)

The following issues were discussed at this parish meeting:-

·         Privacy issues - Advice on the best type of planting and fencing to help screen the gardens of St Peters Place has been received.  A quote for the fencing options was received and discussed but we are still waiting for the planting quote.  Councillors asked the Clerk to follow up some other quotes and look into funding options.

·         Litter – There is still a lot of litter that is just being strewn around the site and not put in the litter bins provided.  The Clerk has requested information from NWBC regarding the days of the week that the bins are emptied.  The response did not fully answer the questions raised and further information will be requested from NWBC.    Fixed penalty notices will be issued for anyone caught dropping litter.

5          Play Equipment-Recreation Ground, Kingsbury continued (974)

·         Roof Turrets on Tower unit – One suggestion from the multi-agency meeting was to remove the roof turrets so that they cannot be climbed onto and provide a shelter.  Councillors did agree to this option subject to information from the company and Safety expert.  The Clerk has now had feedback from the company who fitted the equipment and the Safety Inspector.  They have both recommended that the roof should stay on as there is no long term proven information on the safety of the equipment without the roof  The tower unit was designed to have a roof on.

7          Proposed closure of Libraries including Kingsbury Library (976) 

Despite a lot of work and effort from Members of the Kingsbury Library Campaign Group, WCC has made the decision to close the library on 31st March 2012.

The group will continue to work with the Headteacher of Kingsbury School and the Library service to discuss library facilities for Kingsbury.  It is hoped that a mobile library van may be available for a limited time. 

8          EMR concerns (977)

Problems continue with large lorries using the wrong route to avoid the queues, trailors blocking the road and concerns that the gateway to the site is not big enough.  Head Office has continued to reassure us that they are moving vehicles onto site as quickly as possible.  They have also reported that some of the vehicles blocking the entrance are foreign drivers looking for Kingsbury Link.

We have requested any information from EMR on other vehicles causing traffic problems so that we can pass this onto the companies concerned.

9          Kingsbury Church (979)

Despite a further request for information regarding a complaint about the churchyard internment area being overgrown and a request for the gates to the car park to be locked we have still had no response from the church. 

10        Planning Applications(980) 

Former Public Convenience Coventry Road, Kingsbury – Café and Takeaway

This application has been objected to mainly on the grounds that the proposed building will be taking up some of the recreation ground which belongs to the Parish Council.  Other discrepancies and concerns were also pointed out with the application.

Dosthill Lake – Cllr B Moss reported that this application has been adjourned, but he has given information to WCC on closed footpaths in the area.

Weinerberger – Installation of 70 metre high anemometry mast to measure wind speed etc, temporary for 3 years.  The Parish Council had been made aware of this by Weinerberger at a recent meeting and have no objections.

11        Councillors Parish Matters Raised June (981)

The following comments have been received from the relevant authorities:

NWBC attempted to carry out the repairs for us but found more problems with the posts and reported back to us to see what we wanted to do.  Cllr Moss has been to have a look at the shelter and reported back to Councillors.  The Clerk will contact NWBC to get the work done for us.

14        Councillors Parish Matters Raised September (986)

The following responses have been received from the relevant authorities:

·         Raw sewage smell on Tamworth Road, Kingsbury just past co-op store-This has been reported to Environmental Health at the Borough Council to investigate.

·         Canal Bridge, Bodymoor Heath is crumbling-WCC have inspected and marked pot holes on bridge for repair and arranged for someone from ‘Bridges’ to inspect regarding potential damage to bridge.  They have also noted the bridge railings are leaning and this will also be looked into.

·         Request for dropped kerb in Wood End by Smith Street-This will be assessed.

·         Footpath flooding by 47-51 Tamworth Road, Wood End- Reported for slurry seal.

·         Speed bumps need marking in Wood End-These have now been renewed following surface dressing on Tamworth Road.

·         Ditch opposite Wood End School needs clearing and hedge/grass needs trimming-Request for verge mower to attend to grass verge opposite school.  The landowner is responsible for the hedge. A defect has been issued to cleanse the ditch.

·         Pavement by 29-33 Wood Street, Wood End needs attention-This has been inspected and a defect issued for next patching programme.

·         Trees along Wood Street need a good prune-This has been reported to WCC Forestry and they will investigate but say that pruning will not make a difference to the disturbance of the footpath.

·         Lamp 28 out in Piccadilly-This has been reported and acknowledged.

·         Full dog bags being left on top of bin on children’s play area, Kingsbury-Reported to NWBC but there are no funds to purchase dog bins at present.

·         Last bus from Lichfield does not arrive in time to catch service to Kingsbury-Arriva have stated that they are not able to do anything at the moment but it has been passed onto the Network Planner to review.  Anyone that this affects needs to send the complaint into Arriva so they can see the extent of the problem and how many people it affects.

 15        Meeting with WCC re lorries (987)

 18        Kingsbury Village Welcome sign window boxes

A letter was received from a local company offering their services to provide window boxes for Kingsbury.  This was discussed and it was decided that we would keep the letter on file for the future.

971      Public Questions

There were no questions raised, however, a representative from Beeline Transport attended the meeting to inform Councillors of the current consultation into wider transport need in the community and to ask if we could publicise a questionnaire and the work of Beeline.

972      Minutes to be Approved

It was proposed by Cllr H Phillips and seconded by Cllr M Moss and agreed:

RESOLVED: That the minutes of the Council meeting held on 20th July 2011 are approved as a true record. 

973      Kingsbury Swimming Pool (948)

WCC legal department will contact the Parish Council regarding the process of giving notice on the agreement for pool use when all the queries have been resolved which will now probably be the end of the year and not September as first thought.

974      Play Equipment-Recreation Ground, Kingsbury (949)

The problems with anti-social behaviour in the area and mis-use of the equipment is being reported to the police by residents and a log is being compiled.  The police have increased their patrols in the area which has helped.  A multi-agency meeting was also held to discuss the options. 

The following issues were discussed at this parish meeting:-

·         Privacy issues - Advice on the best type of planting to help screen the gardens of St Peters Place has produced some planting options although they will take time to grow.  Fencing options were discussed at the agency meeting and these will need to be looked into and the cost worked out as funding may be required.  The pros and cons of security cameras and lighting for the area were also discussed.    More advice to be obtained.

·         Litter – There is still a lot of litter reported.  The Clerk will liaise with NWBC to ensure the emptying of the bins is done on days either side of the weekend and twice weekly collections will carry on until the need subsides.  Fixed penalty notices are being issued for anyone caught dropping litter.

·         Roof Turrets on Tower unit – One suggestion from the multi-agency meeting was to remove the roof turrets so that they cannot be climbed onto.  This option was discussed and the Clerk will look into the safety aspect of this before a final decision can be made.

·         Anti-social behaviour - The police are encouraging residents to report any anti-social behaviour so that it can be logged.  They will also speak to the residents and NWBC will arrange for some leaflets to be produced and circulated.

As budgets are very tight at the moment, NWBC are hoping to secure some assistance with fencing on the back of the development currently taking place. Dog bins continue to be a problem to finance across several recreation grounds in the area and will be included in the items to be looked at.  NWBC will keep us informed of any progress.

976      Proposed closure of Libraries including Kingsbury Library (954) 

The final decision will be made at the October Cabinet meeting on the future of the library. 

Members of the Kingsbury Library Campaign Group have again met with the Headteacher of Kingsbury School to discuss library facilities for Kingsbury and are looking at every option to try and save the facility.  Volunteers are being asked to commit their time and funding is being looked into.  If funds cannot be secured by 31st March 2012 then it may have to be closed.

978      Water Park Steps (956)

Cllrs are worried about subsidence of the bank by the steps from the recreation ground to the water park.  WCC have had their engineers inspect the steps and recommendations have been made for future maintenance (no emergency works were recommended).  The work will be added to a program agreed with design services, along with other structures, and will be prioritised on the urgency of the work needed and the monies available.  No timescale can be given at this stage.

979      Kingsbury Church (958)

No response has been received regarding a complaint about the churchyard internment area being overgrown and this will be chased together with the request for the gates to the car park to be locked.

980      Planning Applications(960) 

Further information received - Dosthill Lake, Cliff (part retrospective application for the retention of previously imported waste material in the form of a bund, compensatory flood mitigation works, river bank maintenance and repair, and creation of concrete trackway/boat storage area)

A meeting was arranged with the Environment Agency to discuss the issues further and they explained the situation and measures they are asking for.

No further objections to the proposed planning application will be sent following the extra information.

A new committee has been formed to promote social events at the Bodymoor Heath Community Hall as it has been neglected for many years.  The recent skittles event was a huge success and the committee thanked the Council for their help towards the evening.

The next Parish Council meeting will be held in the hall.

984      Councillors Parish Matters Raised July (967)

The following responses have been received from the relevant authorities:

·         No bus shelters in Hurley – It was suggested that Cllr Simpson bring the item up at a Hurley Community Association meeting and get feedback for us.

·         Request new tarmac for the frontages to the garages in Piccadilly – This work has been issued to a specialist tarmac contractor.

·         A sign is needed for Trinity Road to direct users to the Piccadilly Community Centre – Traffic projects have turned this request down but NWBC are looking into it with the contractors on site.

·         Chain Link fence round bottom of play area in Piccadilly – NWBC hoping to secure some assistance with this on the back of the development.

·         Residents concerned about the vision the dome camera has on Kingsbury School Drive – The camera is pointed at specific areas on the school premises only.

·         Can we find out the legal position regarding anti-climb paint? – It should only be used above head height, a minimum of 2.4 metres off the ground and warning signs should be displayed.

·         Can Kingsbury Church car park gate be closed at night? – This request has been sent to the Church.

·         Dangerous tree branch Bridge Street, Hurley – This has been reported and WCC are dealing with.

·         Tree roots pushing up the path in Wood Street, Wood End, now getting dangerous – This has been inspected and defect issued for patching and put forward for assessment for inclusion in five year footway resurfacing programme.

  • Footway Bodymoor Heath Lane – WCC have put the footway forward to be included in slurry seal programme 2012 from Marston island to Kingsbury Water Park.  The footway will be inspected and defects marked for patching programme.  Also the footway will be included in the next stocking out programme.

987      Meeting with WCC re lorries

The problems with lorries getting stuck and having to reverse because they cannot get under the low bridge at Piccadilly are getting more frequent and are a safety concern.  A meeting has been arranged with WCC to discuss options to help the situation.

988      Kingsbury Liaison meeting with Weinerberger

A meeting has been arranged for September to discuss any areas of concern that the Parish Council has or any items that Weinerberger want to discuss with us.

989      T68 Edge Hill Wood

Items reported during the summer by Cllr Lewis:

·         Stile and fencing broken down – It is the landowners responsibility for fencing (MOD) and the stile is fully functional so WCC report the footpath as no issue.

·         Horses entering the wood via gates and using paths -  This is also the responsibility of the landowner and is not actually a public footpath but a permissive path and so WCC have no power to deal with.

·         Trees, hedges and brambles on the Wood side of Edge Hill – These have been cleared.

948      Kingsbury Swimming Pool (924)

WCC are chasing their legal department who will contact the Parish Council regarding the process of giving notice on the agreement for pool use.  Kingsbury School will be taking over the running of the pool from September 2011.

949      New Play Equipment-Recreation Ground, Kingsbury (925)

The painting of the cradle swing unit will take place at the end of July and the chair for the zip wire will be replaced as it has suffered from wear and tear after only a few weeks use.  The grass seeding will take place again in the autumn. 

The following issues were discussed at the meeting:-

·         Privacy issues - Options to help with the privacy issues are on-going.  Advice on the best type of planting to help screen the gardens of St Peters Place will be looked into.  Also discussions with the police and other relevant bodies regarding security cameras for the area are also taking place, and funding being looked into.    

·         Litter - The second litter bin has now been installed to help deal with the volume of litter and fixed penalty notices are being issued for anyone caught dropping litter.

·         Benches - Two benches are now in stock and will be fitted soon.

·         Anti-social behaviour - The police are encouraging residents to report any anti-social behaviour so that it can be logged.  Also at the Area Forum West meeting Cllrs will put forward that the area should be one of the priorities. 

950      Piccadilly Play Area – gap by the ‘kissing gate’ (926)

NWBC are hoping to make some improvements at the play area.  The gap in the fence and provision of a dog bin will be included in the items to be looked at.  They are hoping to secure some assistance on the back of the development currently taking place.  Councillors asked for more specific information as this request has been on-going for some time.

951      New Sign for Continuing Problems with HGV vehicles through Whateley (927)

The new sign has now been fitted.

952      Litter Bin for Tamworth Road (928)

The litter bin has now been fitted and NWBC will take over the maintenance and emptying of this for us.

953      Cuts to Rural Bus Services (929) 

There have been widespread cuts to bus services around the county and considerable reductions to services for the villages.  

Councillors reported numerous problems that are occurring due to the cuts including standing room only on some routes and buses coming late.  The Clerk has spoken with Arriva who say that there were some initial problems but these should have been sorted out.  Passengers need to contact the bus companies to log the problems so that they can be assessed.

WCC are keeping all correspondence/complaints on file but there is no extra funding for next year at the moment so no plans to put services back on.

George Eliot Hospital have not been made aware of any patients that could not get to their appointments and pointed out that there are services like Beeline to help with transport.

954      Proposed closure of Libraries including Kingsbury Library (930) 

WCC has suspended the decision on all library closures until 19/8/11 and the final decision will be made at the October Cabinet meeting. 

Members of the Kingsbury Library Campaign Group met with the Headteacher of Kingsbury School to discuss library facilities for Kingsbury. 

An expression of interest for the library to become a community hub has been lodged.

Business plans are being put together to try and keep library services going in Kingsbury

955      EMR concerns (931)

Cllr I Thomas reported lots of metal on the road falling from the vehicles and asked the Clerk to alert the company to this.  EMR have sent out a letter to all users to secure their loads and will have staff walk up the road to ensure no metal pieces are around.  There are also reports of containers turning right instead of left out of the site.  The Clerk will update Head Office with the latest concerns.

956      Water Park Steps (932)

Cllrs are worried about subsidence of the bank by the steps from the recreation ground to the water park.  WCC have been to look at the steps and have also raised concerns.  They are waiting for an engineer report on the problem and will let us know the outcome.

957      Bushes by Bus Shelter, Kingsbury (933)

The bushes have now been cut back to enable the police to impose a zero tolerance on litter and can use the cameras to view the area properly

958      Kingsbury/Hurley Church - request for help with graveyard expenses (935)

Councillors considered the applications for help towards the maintenance of the graveyards at Kingsbury and Hurley Churches.  It was discussed at length and proposed by Councillor B Moss and seconded by Councillor M Moss and agreed by a majority vote:-

RESOLVED: That a grant of £950.00 be given to Kingsbury and £850.00 to Hurley Church under the Local Government Act 1972 s214 (6) – the power to contribute towards expenses of cemeteries.

Also a complaint has been received regarding Kingsbury Churchyard internment area being overgrown and this will be raised with the church when sending the grant.

959      Parish Newsletter (936)

All newsletters have now been distributed to all households in the parish and a copy will be put on the website.

960      Planning Applications 

Dosthill Lake, Cliff (part retrospective application for the retention of previously imported waste material in the form of a bund, compensatory flood mitigation works, river bank maintenance and repair, and creation of concrete trackway/boat storage area)

Objections to the proposed planning application have been sent.  The size of the bund, flooding issues for local residents and the closure of public footpaths were all mentioned.

A meeting is being arranged with the Environment Agency to discuss the issues further.

HS2 Responses to Consultation

The Parish Council’s objections and points of concern were sent off in time for the deadline of 29th July.  The Borough Council has submitted a more detailed statement of the effects on the community.

961      Councillors Parish Matters Raised June (940)

The following comments have been received from the relevant authorities:

·         The grass bank on Coventry Road needs cutting – Reported but not yet mowed.  Clerk to chase.

·         Vehicle has ploughed through the verge on Coventry Road and there is now a water problem in the dip – Reported awaiting further information.

·         Speed sign not working By Mill Crescent – This has been reported to WCC and they have acknowledged request.

·         ARC drivers moving sand are using short cut – The Clerk requested more information as no contact details could be found.

·         Problem with queues on buses in Corporation Street, Tamworth on the 115 bus since the cuts – Arriva are dealing with the initial problems caused by the bus cuts.  Residents advised to report any problems with bus journeys so that they are logged with the company and can be used for future use.

962      Volunteer Centre North Warks – Request for Funding Support (941)

A letter of thanks has been received from the Volunteer Centre North Warwickshire for the donation given towards their costs.

922      Public Questions

Residents from St Peters Place, Church Lane, Kingsbury attended the meeting to convey their feelings on the effect the new play area has had on their community.  Many of the issues are police matters and they were advised to keep reporting to the police so that any anti-social behaviour can be dealt with.  Councillors also agreed to visit the residents to discuss the issues from their perspective.

Further discussions will take place to find solutions.  See minute 925 also.

924      Kingsbury Swimming Pool (905)

WCC have reported that they are still working with the school for a September hand over.  They will contact the Parish Council regarding the legal process of giving notice on the agreement that we have with them for pool use.

925      New Play Equipment-Recreation Ground, Kingsbury (906)

The play area is now complete apart from the painting of the cradle swing unit and grass seeding in the autumn.  The opening event was held on 21st May and was a huge success.  The following issues were discussed at the meeting:-

·         Privacy/height issues.  The planning department have now confirmed that they are satisfied with the height of all equipment.  Options to help with the privacy issues are being looked into – see minute 922. 

·         Kay Alexander from the BBC news team kindly agreed to open the event for us and Councillors offered to give a donation to a charity she is involved with as she gave her services free of charge.  It was proposed by Councillor J Thomas and seconded by Councillor M Moss to give £300 donation to Mary Ann Evans Hospice.  This was agreed by all.

RESOLVED: That a donation would be sent to Mary Ann Evans Hospice in the sum of £300

·         The Borough Council has increased the litter picking and litter bin emptying for us and a further litter bin is on order to deal with the volume of litter.  This will be monitored when the new bin is in place to see if more action is needed.

·         Originally there were benches on the plans, but following negotiations with the Contractors to get the tarmac included in the price we had to lose the benches.  Following numerous comments from grandparents and parents that they had nowhere to sit and watch the children play, two benches are on order.

·         The insurance has been amended to cover the new equipment and it was agreed to maximise the cover to include all safety matting also.

·         Unfortunately there has been some graffiti and damage to the site.  The police have dealt with the offenders.  The police are encouraging us to look into CCTV for the area.  The Clerk has been asked to see if any funding can be obtained and to contact NWBC to see if they can help with any ideas.

929      Proposed cuts for Rural Bus Services (910) 

There are widespread cuts to bus services around the county and considerable reductions to services for the villages.  Letters have been sent indicating our concerns at how many cuts are being made without any consultation taking place with the people it affects most. 

Councillors reported numerous problems that are occurring due to the cuts including standing room only on some routes and buses coming late.  The Clerk will write to the bus companies and forward correspondence to the MPs office.

930      Proposed closure of Libraries including Kingsbury Library (911) 

The main consultation on the proposed closure started on 17th March 2011 for a period of 12 weeks.  An expression of interest has been lodged to keep the matter open and more meetings will follow to see if the library can be saved from closure.

931      EMR concerns (913)

EMR have told us that they have made dramatic improvements to the site and have implemented a system where they call drivers to ensure there is waiting room on the site.  This seems to have made a difference although some Councillors have still noted lorry queues.

935      Kingsbury/Hurley Church - request for help with graveyard expenses

The application for help towards the maintenance of the graveyard at Kingsbury Church has been received, together with the financial records.  Hurley’s request came too late to put on the agenda and more financial  information was needed.  It was discussed and it was proposed by Councillor A Jenns and seconded by Councillor K Carr and agreed by all:-

RESOLVED: That in future both Kingsbury and Hurley Churches will be told they must submit accounts and requests in June and they will be discussed together at the July meeting each year.

Councillors were all given a copy of the typed up newsletter that the Clerk had produced.  They thought the newsletter looked very professional and made a few suggestions for slight changes.  They were asked to make any further comments/changes within 48 hours so that the Clerk could send it to the printers in time to get them back for NWBC  to send out with their issue of Northtalk.  They would then go to all houses in the parish.    It was proposed by Councillor K Carr and seconded by Councillor B Moss that £150 should be given to the deliverers.

RESOLVED: That £150 be shared with the deliverers of the newsletters.  The Clerk to check on how this payment would be made.

937      Accounts for 2010/2011

The internally audited accounts for 2010/2011 were circulated to all at the meeting (the Councillors had seen copies of the unaudited accounts at the previous meeting, and no changes had been made).  The audit report was also circulated to all and discussed before the accounts were signed.  It was proposed by Councillor H Phillips and seconded by Councillor B Moss and agreed by all:

RESOLVED:-That the accounts for 2010/2011 be approved subject to external audit, and also the Statement of Assurance in the Annual Return.

Following the acceptance of the accounts, the Chair signed the Statement of Assurance and the Annual Return.  These documents would be sent to the external auditor by the deadline of the end of June.

638      Clerk’s Annual Pay Review

RESOLVED: That, under Section 100A of the Local Government Act 1972, in view of the confidential nature of the business about to be transacted, it is advisable that if any public are present that they be temporarily excluded.  This will be recorded as a separate confidential minute.

939      Planning Applications 

Achray, Coventry Road, Kingsbury

The parish council have sent their objections into the Borough Council as they feel this application would be an over intense development in the area and not in keeping with the surrounding properties.

941      Volunteer Centre North Warks – Request for Funding Support

A letter has been received from the Volunteer Centre North Warwickshire asking for a donation towards their costs.  A copy of their annual report was also enclosed.  Following discussions it was proposed by Councillor I Thomas and seconded by Councillor A Lewis and agreed by all:

RESOLVED: That a donation of £250 be given to the Volunteer Centre to help with their work in North Warwickshire.

942      Damage to Wooden Bus Shelter

The Clerk had received reports of damage to the wooden bus shelter.  Some slats have been kicked out and there was previous damage to the roof.  So that Councillors had all the information necessary to decide on further action, the Clerk had already asked the Borough Council for a repair cost.  It was proposed by Councillor C Ayasamy and seconded by I Thomas and agreed by all that:

RESOLVED:  The Clerk asks NWBC to repair the shelter for us at a cost of £240 for materials and labour.

905      Kingsbury Swimming Pool (880)

The Pool Steering Group met on 27th April.  The school is in final negotiations to take over the pool for an initial 12 month period.  We have not yet heard anything official from WCC regarding the situation and the agreement that we have with them regarding pool use.

906      New Play Equipment-Recreation Ground, Kingsbury (882)

The play area is almost complete and will be ready for the opening event on 21st May.  An independent site inspection will be carried out before signing over the play area to ensure all items are up to safety standards.  The following issues were discussed at the meeting:-

·         Privacy/height issues.  These matters were discussed at length and options are being looked into.  The Clerk is waiting for further information. 

·         The Clerk has been working with NWBC on the opening event.  Kay Alexander from the BBC news team has kindly agreed to open the event for us and other arrangements are in place. 

·         We have already instructed the Borough Council to increase the litter picking and litter bin emptying for us, and it was discussed that we should purchase another litter bin.  This was proposed by Councillor B Moss and seconded by Councillor K Carr and agreed by all.

RESOLVED: That a further litter bin would be purchased for the Recreation ground at a cost of £587.90 plus VAT.

907      Piccadilly Play Area – gap by the ‘kissing gate’ (883)

NWBC are hoping to make some improvements at the play area.  The gap in the fence and provision of a dog bin will be included in the items to be looked at.  No further information available.

908      New Sign for Continuing Problems with HGV vehicles through Whateley (884)

We are still waiting for a date for the new sign to be fitted, but are assured that the matter is being dealt with by WCC.

909      Litter Bin for Tamworth Road (885)

We are awaiting a delivery and fitting date.

910      Proposed cuts for Rural Bus Services (890) 

There are widespread cuts to bus services around the county and considerable reductions to services for the villages.  Letters have been sent indicating our concerns at how many cuts are being made without any consultation taking place with the people it affects most.  We are awaiting a response.

911      Proposed closure of Libraries including Kingsbury Library (891) 

The main consultation on the proposed closure starts on 17th March 2011 for a period of 12 weeks.  There will be a consultation event at Kingsbury Youth Centre at 6.00pm on 16th May 2011.  More information can be found on the Warwickshire County Council, Kingsbury Parish Council and Kingsbury Village websites.

912      West Midlands Water Ski Centre Flooding Issues (895 & 804 January 2011)

There is still an outstanding legal case on this matter and therefore cannot be discussed further with us at this stage.  The Environment Agency has said that a planning application is expected to identify a solution to the environmental issues on the site.  More details will be available when this is received.

913      EMR concerns (896)

EMR have told us that they have made dramatic improvements to the site and have implemented a system where they call drivers to ensure there is waiting room on the site.  A regional environmental co-ordinator is monitoring the site.

They will also endeavour to keep the stack height down and noise levels as far as possible.  They have installed a screen around some of the noisier equipment.

Following complaints raised at the Area Forum, the Fire and Rescue Service have also visited the site and were happy that the premises adhered to the regulations on Fire Safety.

Further contact can be made to the Environmental Health Manager regarding noise levels.

·         Tipping and untidy site at Whateley – Arrangements have been made by NWBC to clear the site of fly tipping.

The police have asked if we could get the bushes/trees cut back by the bus shelter that backs onto the recreation ground in Kingsbury so that they can impose a zero tolerance on litter and can use the cameras to view the area properly.  The Clerk will liaise with the Forestry Department at WCC and the Police and get a price for the work.

881      Steps and footway into the Water Park (853)

WCC have informed us that the work to raise the handrail has now been completed.

882      Proposed New Play Equipment-Recreation Ground, Kingsbury (854)

The play area now has most of the equipment open for use.  The area for the kick about goal end and basketball net still needs to have the tarmac laid.  We have had some very positive feedback and the children seem to be enjoying the new, long awaited modernisation of the site.  Unfortunately the minority are causing concerns by climbing onto the roof of the tower unit.  Thankfully, the police have been able to identify some of the culprits and they have been dealt with.  The message from the police is that if anyone is behaving in an anti-social way then they need to be reported so that they can be dealt with.

The following issues were discussed at the meeting:-

·         The Clerk has already written to the residents who are concerned about the height and privacy issues.  However, further correspondence has been received.  These matters were discussed at length and the Clerk has been asked to look into various solutions, which will be reported on and discussed further at the next meeting.  A reply will be sent to those concerned.

882      Proposed New Play Equipment-Recreation Ground, Kingsbury continued (854)

·         The Clerk will liaise with NWBC regarding the opening event.  More information will be available at the next meeting.  The date is confirmed as 21st May 2011.

·         We have received numerous reports of excessive litter since the equipment was opened and the weather improved.  As a solution to this we have instructed the Borough Council to increase the litter picking and litter bin emptying for us, and we will include the purchasing of another litter bin on the next agenda for discussion.  Proposed by Councillor J Thomas and seconded by Councillor K Carr and agreed by all.

RESOLVED: That the litter pick and litter bin emptying on the Church Lane Recreation ground be increased to weekly until September and the purchase of another litter bin would be included in the next agenda for discussion at the next meeting.

WCC are unable to carry out any investigation at the present time due to funding being limited.  However, the requests will be put on file to be investigated in the future when funds become available. 

887      Request for seat for Jubilee Ct bus shelter, K’bury (861)

A perch seat has now been fitted in the Jubilee Court shelter.

888      Audit of Accounts (864)

The Clerk is currently working on the Parish Accounts for 2010/2011 and they will be passed to the Internal Auditor, who has now confirmed his acceptance to audit the accounts for us, when they are completed. 

889      KPC Bank Accounts  (867)

The bank has now completed the request to merge the two Reserve Accounts into one account.

890      Proposed cuts for Rural Bus Services (869) 

There are widespread cuts to bus services around the county and WCC have sent us details of the bus service changes that will be affecting the parish from Tuesday 31st May 2011.  There are considerable reductions to services for the villages.  A letter has already been sent indicating our concerns, but Councillors have asked the Clerk to write again to WCC and the MP as they are amazed how this many cuts could be put in place without any consultation taking place with the people it affects most.  The lack of consultation will also be looked into.

891      Proposed closure of Libraries including Kingsbury Library (870) 

The Kingsbury Library Campaign Group made up of a small group of residents and Councillors organised a public meeting to look into saving the library.  The meeting was well attended and the general opinion was that residents wanted the library to stay where it is.  

As an option there has since been a meeting held at Kingsbury School to see if it could be incorporated into the school site, but this was not possible for a number of reasons.  Further ways of keeping it open are being looked into.  The main consultation on the proposed closure starts on 17th March 2011.  There will be a consultation event at Kingsbury Youth Centre at 6.00pm on 16th May 2011.  More information can be found on the Warwickshire County Council, Kingsbury Parish Council and Kingsbury Village websites.

892      Councillors Parish Matters raised March 2011 (872)

The following comments/responses were received from the relevant authorities:

  • Who holds the key to the gate lock Sycamore Road? – This is held by NWBC and arrangements are being looked into for next season.  Anyone interested can contact A Wilson at NWBC if they want any information in the meantime.
  • Can the path by Piccadilly Community Centre be cleaned regularly – This will be looked at during the current review of grounds maintenance arrangements.
  • Request a dog bin for Piccadilly as dog owners are using the litter bin on the play area to dispose of dog mess.  Contact the dog warden for notices etc. – See minute 883 and the Dog Warden has said she will put some notices up in the area.
  • The secure gate by 24 Meadow Road has no hard surface and is very muddy – This has been inspected and a request put in to reinstate the area with tarmac.
  • Black path near to Daw Mill still has debris from last summer – This will be looked into.
  • Step is needed from raised walkway by Church steps, Water Park – Due to committed expenditure, budget cuts and staffing changes there is a need to prioritise essential repairs over improvement works so this is not possible to action at this time.
  • Pole number 1 Wood Street – This has been reported and will be repaired.

896      EMR concerns

A letter of complaint has been received from a resident regarding the noise and traffic chaos caused by EMR and the size of the site.  Councillors have raised their concerns many times regarding this in the past.  The Clerk has been asked to follow this up with NWBC and EMR to see what can be done.

898      Kingsbury Youth Centre

The Youth Centre is likely to close in December 2011.  Please support the public meeting on 24th May at the Youth Centre at 7pm.

899      Clerk’s computer equipment

The Clerk has had to replace her computer, printer and purchase a new word program to enable her to complete the parish work.  She asked if the parish would help with the printer and program costs and it was proposed by Councillor B Moss and seconded by Councillor H Phillips and agreed that  

RESOLVED: The Clerk would claim back the money for the printer and program at a cost of £126.94.  These would then be the property of the Parish Council.

900      Next Meeting Date Change

Due to the business needed to be dealt with at the Annual meetings of the parish, and the fact that the original date clashed with the Borough Council’s 1st meeting following the election, it was proposed by Councillor H Phillips and seconded by Councillor J Whitby that the meeting date be changed on this occasion to 11/5/11.  This was carried by a majority vote.

The next meeting will now be Wednesday, 11th May 2011 at Kingsbury School, Kingsbury.

852      Kingsbury Swimming Pool (824)

The pool is being funded for a further 6 months until September, to enable on-going negotiations with the body interested in taking over the pool.  More information will be provided as it is received.

853      Steps and footway into the Water Park (825)

The steps have now been cleared of any mud and debris.  WCC will also get a price for raising the low hand rail so that it is on the records for the future, as at the present time with the proposed budget cuts, non essential work has to be prioritised.

854      Proposed New Play Equipment-Recreation Ground, Kingsbury (826)

The Clerk has written to the residents who are concerned about height and privacy and ask that they monitor the situation for a while when the playground becomes open, to see if their concerns are found to be a problem.  However further correspondence has been received from them and this is being looked into.  The matter will be discussed further at the next meeting. 

The Clerk has spoken to NWBC regarding the opening event.  All ideas and dates and times were discussed and Councillors agreed that it was a good idea to promote ‘Play in Kingsbury’ and have a joint opening event for the Parish recreation ground and the Sycamore Road play area on 21st May 2011.  Councillors opted for the 10am to 12pm slot for the parish site.  Further details will be discussed at the next meeting and then will be advertised using various forms of media.

855      Piccadilly Play Area – gap by the ‘kissing gate’ (827)

This is still a matter that NWBC are looking into. 

856      Quality Parish Status-QPS (828)

The requirements and the benefits of becoming a Quality Parish were discussed at length.  There are many requirements that have to be addressed.  Kingsbury Parish Council already cover some of the criteria such as a website for providing information to the community.  It was felt that there was a lot of time and work involved producing four newsletters a year which is another one of the criteria.  It was however agreed that a newsletter was a good idea and that the first one could possibly be issued after the opening of the new play area.  Any further issues would be decided by Councillors when they felt they were necessary.

Therefore, after discussion, it was decided not to move forward with the Quality Status at the present time, as Councillors felt that there was not enough to be gained for the Council or the community.

857      New Sign for Continuing Problems with HGV vehicles through Whateley (830)

The new sign, which shows a road narrows sign above a lorry crossed through saying not suitable for HGVs, is now ordered and awaiting fitting.  We have no date yet for completion.

858      Litter Bin for Tamworth Road (831)

We are still awaiting delivery and fitting of the litter bin, which will hopefully not be too much longer.

859      Request for a Pelican Crossing Kingsbury (833)

Request for a pelican crossing on Coventry Road by Mill Crescent, Kingsbury – The need for a crossing has to be assessed by WCC initially using various criteria and there are very limited funds which are not available until next financial year.  Further information is awaited from WCC.

860      Councillors Parish Matters raised October 2010 (834)

The following responses/updates have been received from WCC:

  • Lamp 9 out Hurley – WCC are waiting for E-ON for the connection of this lamp.
  • Missing Lamp Edge Hill and light on telegraph pole, Tamworth Road, Wood End not done – This pole bracket will be ordered and then E-ON will need to fit it.

These may take a while as WCC are dependent on E-ON contractors.

Sportsmans Arms, Perryman Drive, Piccadilly – Demolition of public house and re-development consisting of 19 no: 2/3 bedroom dwellings with associated car parking.  A site visit has taken place and the application has now been granted.

Kerrycroft, Kingsbury - Change of use to a Nursery.  Following our concerns regarding the access to Kerrycroft, we have been told by the Planning Department that the agent is requesting that a 1 metre wide footway to one side of the improved access road be conditioned.

Land off Tamworth Road, Cliff   WCC have notified us of a part retrospective application for importation of 15000M3 of topsoil for the improvement of agricultural land, access track and temporary car parking for the duration of the work at land off Tamworth Road, Cliff.

863      Councillors Parish Matters raised January 2010 (837)

The following responses/updates have been received from the relevant authorities:

  • Zebra/Pelican crossing request for Trinity Road – This request is being looked into by WCC.  See also minute 859.
  • Bus companies not putting all customers through the ticket machines – Letters have been sent to Arriva and Stagecoach with concerns that the total number of passengers are not being recorded accurately. A letter was in the Tamworth Herald also commenting on this.  A response was received from Arriva stating what should happen but they seem to have missed the point that it is not happening.  A further response has been sent.
  • Dog mess by co-op store, Kingbury – The Dog Warden spoke to the Clerk and offered some options/measures that could be taken to help prevent this.  It has been cleaned up and the Clerk will report back to the Warden.

864      Review of Effectiveness of Audit (839)

A letter has been sent to the Internal Auditor for him to sign.  This will be his acceptance to audit the 2010/2011 accounts for us.  A reply is awaited.

865      Requests for help with funding (840)

The following letters of thanks have been received:-

  • Wood End Tigers Junior Football Club – A thank you letter has been received for the help towards the new all-weather jackets for the squad. 
  • Hurley Village Hall roof repairs –The Community Association have thanked the parish for donating towards the roof repairs and will acknowledge this in their next newsletter.

866      Grounds Maintenance Services for 2011/2012 (841)

The costs for services for 2011/2012 have been compared to last year and show a small reduction in costs.  It was agreed that the costs for the recreation ground would be monitored due to the changes for the new play area and would be adjusted next year.

867      KPC Bank Accounts - proposed change to Reserve Account (842)

The bank required more signatures to clarify the changes before they could close the account and transfer it.  This was duly signed.

868      Councillors Parish Matters raised February 2011 (843)

The following responses/updates have been received from the relevant authorities:

  • Mud on road by EMR recycling and traffic queues – This was inspected and was clear but a sweeper is regularly deployed when needed.
  • Large pothole on Knowle Hill – This has been made safe.
  • Water leak junction Boulters Lane/Tamworth Road – This has been reported to STW and is on their list to repair.
  • Mud on road A4097 adjacent Marston Fields Farm – The landowner has been contacted and it has been cleared and a sweeper used.
  • Litter pick needed from Wood End to Piccadilly on Trinity Road – This has been cleaned.

869      Proposed cuts for Rural Bus Services (845) 

Councillors are concerned about proposed cuts to village bus timetables.  A list of proposed reductions in service was received from WCC and copied to all Councillors.  These were discussed and the concerns would be sent to WCC.  The Clerk was asked to liaise with other parishes on the matter.

870      Proposed closure of Libraries including Kingsbury Library (846) 

A small group of residents and Councillors organised a public meeting to establish how much support there is in the community and to discuss what can be done to try and save the library.  The meeting was well attended and the general opinion was that they wanted the library to stay where it is.  The main consultation starts on 17th March 2011.  There will be a consultation event at Kingsbury Youth Centre at 6.00pm on 16th May 2011.  More information can be found on the Warwickshire County Council, Kingsbury Parish Council and Kingsbury Village websites.

873      Tumbletime Group, Kingsbury

A letter has been received asking for help towards storage boxes and shelving for the Tumbletime group who use the Methodist Church on Thursday mornings.  The total cost being £78.88.

874      Hurley/Kingsbury Surgeries

Councillor J Thomas reported that Hurley surgery would be closed until June and then it will be open five days a week but for appointments only.  The dispensary at Hurley will also continue from June.

The open surgeries at Kingsbury will remain with two Doctors.

823      Minutes to be Approved

RESOLVED: That the minutes of the Council meeting held on 19th January 2011 are approved as a true record. 

824      Kingsbury Swimming Pool (800)

A report on the progress made by the Steering Group was considered at the Cabinet meeting of Warwickshire County Council in February.  The Cabinet unanimously voted to fund it for a maximum of a further 6 months to enable ongoing negotiations to continue with the body interested in taking over the pool.  However, if the transfer is not completed in the six months then formal closure proceedings will have to commence in September.

825      Steps and footway into the Water Park (780)

WCC have asked for further evidence of the mud on the steps as their reports showed that the problem was now much improved.  If necessary they will then ask some volunteers to clear this and any overgrown vegetation along the steps.  WCC will also get a price for raising the low hand rail so that it is on the records for the future, as at the present time with the proposed budget cuts, non essential work has to be prioritised.

826      Proposed New Play Equipment-Recreation Ground, K’bury (802)

There have been concerns received from local residents that some of the equipment is too high and too close to the graveyard.  We have had a site meeting with the contractors to discuss the height issues, proximity to the graveyard and houses, and any other issues raised.  This has been discussed at length by Councillors, and HAGs will modify the tower unit and zip wire, so that they do not exceed the height of 4 metres.  These will then comply with any planning guidelines.  The proximity of the log swing to the fence is well within the guidelines as the actual swinging part is well inside the frame area.  Concerns that this may be climbed and gain views into gardens was agreed to be monitored to see if any further action was needed.

The Parish Council did agree to move the football kick about pad to a more central position to keep it well away from the graveyard as the original place that was marked out was considered to close after further discussions.  There was to be a further cost to do this and the Clerk was asked to clarify the legal situation before we agree to the costs.

The Clerk will write to the residents who are concerned about height and privacy and ask that they monitor the situation for a period of six months when the play ground becomes open, to see if their concerns are found to be a problem.  If they are then there are measures such as planting that could be considered as we want the new play area to be a success and a well used facility for Kingsbury, but we do not want to cause any distress in the process.

827      Piccadilly Play Area – gap by the ‘kissing gate’ (803)

This is still a matter that NWBC are looking into. 

828      Quality Parish Status-QPS (805)

It was decided to discuss the Quality Parish Status more fully at the next meeting.  It was felt that a newsletter would still be a good idea, but four newsletters a year which the QPS requires would be a lot of work.

829      Marking of road and speed humps in Wood End and Hurley (806)

WCC are aware of the areas that still need to be completed.

830      Continuing Problems with  HGV vehicles through Whateley (807)

The new sign, which shows a road narrows sign above a lorry crossed through saying not suitable for HGVs, is now ordered and awaiting fitting, hopefully in the next few weeks. 

831      Litter Bin for Tamworth Road (808)

We are now awaiting delivery and fitting of the litter bin.  NWBC have agreed to take over the maintenance and emptying of the bin for us and we have consulted them regarding the best place for it to be sited.  County Highways have stated that they have no objections to this.

832      Councillors Parish Matters raised September 2010 (809)

State of access road to Bottom Lock Cottages, Bodymoor Heath – logged as reference 267810 at County Highways.  Highways have reported that this is not adopted and therefore the responsibility of the land owner.  The parish council can do nothing further unless any more information is received that may require our help.

833      Request for a Pelican Crossing Kingsbury (810)

Request for a pelican crossing on Coventry Road by Mill Crescent, Kingsbury – The need for a crossing has to be assessed by WCC initially using various criteria and there are very limited funds which are not available until next financial year.  We must now wait for any further information from WCC.

836      Planning Applications discussed

Sportsmans Arms, Perryman Drive, Piccadilly – Demolition of public house and re-development consisting of 19 no: 2/3 bedroom dwellings with associated car parking.   The parish council sent objections and concerns regarding this planning application because it was breaking the building line of Piccadilly village and will therefore be using green belt land.  Also the access via Perryman Drive was inadequate.  A further application was received with a change of access but there were still concerns so a further objection/observation statement was sent from the Parish Council.  We have since heard from NWBC that the application has now been postponed to enable a site visit and further consultation.

Kerrycroft, Kingsbury - Change of use to a Nursery.  We are not objecting to the change of use, but observations/concerns were sent to NWBC regarding the extra traffic that this would generate for Kingsbury Hall Drive and the safety of pedestrians.  The drive is a narrow track that does not allow cars to pass side by side and it is not adopted road.

  • Can Piccadilly Crescent be gritted in bad weather? – WCC have reviewed the site taking into account the criteria they have to work from.  They are unable to include this within their primary routes, but they have put it on their secondary routes list for inclusion in prolonged periods of severe weather.
  • Northtalk not delivered to some houses in Kingsbury – NWBC have noted this for the next issue which is likely to be the summer one.

  • Hurley Village Hall roof repairs – Extra costs for roof repairs have come to light during the refurbishment of the village hall and the Community Association have asked the Parish Council as trustees if they can help with some of the extra cost.  £800.00 was proposed by Councillor H Phillips and seconded by Councillor I Thomas and agreed.
  • North Warwickshire Arts – Request to help with cost of running the bi-annual Arts Festival to be held on 7th October 2011. £200.00 was proposed by Councillor H Phillips and seconded by Councillor A Jenns and agreed.

840      Requests for help with funding continued

RESOLVED: That the agreed amounts be paid to Wood End Tigers JFC £250, Hurley Community Association £800 and North Warks Arts £200.

It was also agreed that in future any requests for funding should have the relevant accounts and costs included so that an informed decision can be made.  Notification of any help from the Parish Council should also be put into any statements/reports to acknowledge our support.

841      Grounds Maintenance Services for 2011/2012

The costs for services for 2011/2012 have been received from NWBC.  It was proposed by Councillor H Phillips and agreed by all that the Clerk would compare the prices to last year and as long as there are no significant changes in costs that they be accepted.  The Clerk will report back to the next meeting when the quote can be formally agreed.

842      KPC Bank Accounts - proposed change to Reserve Account

The Clerk reported that one of the Council’s bank accounts had been changed by the bank to a Reserve Account.  We already hold a Reserve Account and the Clerk had prepared a letter to be signed by the required signatories to ask the bank to merge the money into one Reserve Account.  This was proposed by Councillor H Phillips and seconded by Councillor J Thomas and agreed.

RESOLVED: That a letter be sent to the bank to merge the two Reserve Accounts held by the Parish Council into one account.

844      Patients Participation Group Conference 17th June 2011

Councillor C Ayasamy informed Councillors of a PPG Conference on 17th June regarding changes in the National Health Service.  More information will be sent out to local bodies/agencies at a later date but if you require any further information please contact J Thomas on 01827 874004.

WCC have asked the Water Park what arrangements they have made to do some maintenance work to clear the steps and overgrown vegetation, but still no response has been received.  This will be chased again for an update as the steps are still in need of clearing.

The weather has severely delayed the work installing the equipment and it is still not finished.  There have been concerns received from local residents that some of the equipment is too high and too close to the graveyard.  We have had a site meeting with the contractors to discuss the height issues, proximity to the graveyard and houses, and any other issues raised.  This has been discussed at length by Councillors and we will be working with HAGs to modify certain items and get distances checked to ensure that we are working within guidelines set by NWBC planning department and safety guidelines for the equipment.  Further update in the next parish minutes.

804      Concerns regarding flooding and West Midlands Water Ski Centre (779) 

It was decided to remove this item from the minutes as we are happy that the matter is being dealt with by the Environment Agency.  It is a lengthy process and due to legal restrictions the information on progress cannot be published.

805      Quality Parish Status (780)

No further progress has been made with this due to the workload associated with the new playground in Church Lane, Kingsbury and the budget/precept report being prepared.  The proposed newsletter is on hold until we have definite information on the completion and opening event for the playground which has been delayed by the bad weather.

Councillor A Simpson reported that only half of Knowle Hill had been lined.  WCC were aware of Smith Street, Wood End.  The Clerk will update WCC.

The new sign, which shows a road narrows sign above a lorry crossed through saying not suitable for HGVs, is now ordered.  The exact cost was £1229.00 which was higher than we had expected.  The Clerk queried this and WCC agreed to absorb some of the staff time costs and it would bring the cost to us down to £1094.00.  It will take approximately 12 weeks to complete the order and fitting of the sign.

The procedure for the ordering and fitting of the litter bin are now in place.  NWBC have agreed to take over the maintenance and emptying of the bin for us and County Highways have stated that they have no objections to this.

809      Councillors Parish Matters raised September 2010 (788)

The following responses were received from the relevant authorities:

·        Concerns re the stile into field at the bottom of Mill Crescent – WCC

have established that the stile is not on public footpath T55 or on a Public Right of Way. It is a stile on a route used by fishermen and there is no action that the Countryside Access Team can take on this as it is a private right being exercised on private land.

Request for a pelican crossing on Coventry Road by Mill Crescent, Kingsbury – The need for a crossing has to be assessed initially using various criteria and there are very limited funds which are not available until next financial year.  The level of justification is the essential starting point for comparing sites to ensure that available resources are used effectively. The site can be assessed and WCC asked for an exact location in order to do this which will be sent to them.

811      Councillors Parish Matters raised October 2010 (791)

The following responses/updates have been received from the relevant authorities:

  • Uneven tarmac on Tamworth Road, Kingsbury (no 29-35) – This has been checked by County Highways and found not to be in need of any work at the present time.
  • Trees need pruning - St Margarets, Kingsbury – A letter has been sent to ask the owners to cut back vegetation adjoining bench junction Tamworth Rd.
  • Lamp 9 out Hurley – There still seems to be a problem with this and it will be reported again.
  • Missing Lamp Edge Hill and light on telegraph pole, Tamworth Road, Wood End not done – This will also be reported as still damaged.

812      Request for seat for Jubilee Ct bus shelter, K’bury (792)

The quote has now been received for a perch seat for the Jubilee Court bus shelter in Kingsbury.  The price has come in at more than we agreed due the size of the shelter and the position for fixing the seat.  Also the cost for fitting has been added.  The costs were discussed and it was proposed by Councillor A Jenns and seconded by Councillor K Carr and agreed by all

RESOLVED: That a 2 bay perch seat be purchased with fitting at a revised cost of £348.00 for the Jubilee Court bus shelter.

813      Requests for funding help (793)

  • Vitalise essential breaks for disabled people and carers – A letter asking for support was received which included expenditure for the whole of Warwickshire.  Councillors requested further information on expenditure in Kingsbury parish and unfortunately there was no evidence that any local residents had benefited from what Vitalise offer so a donation was not given.  
  • Kingsbury Aquarius – A request for help with pool costs was received.  Councillors felt that this was not a cost that the parish council could help with, however, they have always said that they would consider supporting items of expenditure for example that could be specifically itemised, however this must be requested when a purchase is being looked into.

814      Council Taxbase and Precept Requirements for 2011/2012

Councillors considered a report provided by the Clerk, based on current expenditure and estimated out-turn for 2010/2011.  Councillors discussed this at length and it was proposed by Councillor I Thomas and seconded by Councillor A Lewis and agreed:-

RESOLVED: That an expenditure budget of £30,000 be approved for the year 2011/2012, and that the precept levy on North Warwickshire Borough Council would be £30,000 with no increase from last year.

815      Planning Applications

Sportsmans Arms, Perryman Drive, Piccadilly – Demolition of public house and re-development consisting of 19 no: 2/3 bedroom dwellings with associated car parking.   The parish council sent objections and concerns to this planning application because it was breaking the building line of Piccadilly village and will therefore be using green belt land and the access via Perryman Drive is inadequate.

818      Review of Effectiveness of Audit

A meeting is required once a year to review the accounts procedures for audit purposes.  The Chair, Vice-Chair and Clerk met in January to discuss this.  The outcome was that the system of accounting and the procedures in place by the Clerk and Internal Auditor are more than satisfactory and there is no need for any changes to be made.  It was proposed by Councillor I Thomas and seconded by Councillor B Moss and agreed by all:

RESOLVED: That a letter would be sent to the Internal Auditor each year for him to sign.  This would be his acceptance to audit the 2010/2011 accounts for us at the agreed price which for now would remain unchanged.

819      Future Meeting Dates

This will be Wednesday, 16th February 2011. at Piccadilly Community Centre, Piccadilly. 

Councillor I Thomas proposed and Councillor A Jenns seconded that the dates for the parish meetings be agreed as the third Wednesday in the month.  This was upheld by majority vote.

RESOLVED: The Meeting Dates for 2011 were agreed as the third Wednesday in the month (except August and December) and will be posted on the website and notice boards around the parish.
